On the positive side, if you woke up in a bathtub full of ice missing a finger, I'll bet you can make $50,000 and get your finger back as long as you can match fingerprints with it.

SAN JOSE, Calif. - A woman who claimed she scooped up a human finger in her chili at a Wendy’s restaurant has decided not to sue the fast-food chain.

Anna Ayala dropped her claim because it “has caused her great emotional distress and continues to be difficult emotionally,” said her attorney, Jeffrey Janoff.

Ayala, 39, claimed she found the 1˝-inch long fingertip on March 22 while dining at a Wendy’s restaurant in San Jose. She later filed a claim with the franchise owner, Fresno-based JEM Management Corp., which her attorney had said was the first step before filing a lawsuit.

Court records show Ayala has a history of making legal claims against corporations, including a former employer, General Motors and a fast-food restaurant. She acknowledged she received a settlement for medical costs several years ago after claiming that her daughter was sickened after eating at a Las Vegas restaurant.

Phone calls to Ayala’s house in Las Vegas went unanswered Wednesday. Investigators searched her home last week as part of their probe into how a finger ended up in the chili.

San Jose police say they’re investigating a possible connection between the finger and the owner of several exotic animals at Pahrump, Nev., who lost one of her fingers in a leopard attack on Feb. 23.

The San Jose Mercury-News said the finger could not be reattached and was returned to the woman, Sandy Allman. She has an unlisted number and could not be reached by The Associated Press for comment.

Wendy’s spokesman Denny Lynch declined to comment on Ayala’s decision to drop the lawsuit but said a reward hot line to receive tips will remain open. Wendy’s has offered $50,000 to the first person who can provide verifiable information that identifies the origin of the finger.

“It’s very important to us to find out what really happened at the restaurant,” Lynch said. “We will continue to fully cooperate with the police investigation.”

Wendy’s maintains the finger did not come from any of its ingredients. None of the employees at the San Jose store had lost any fingers, and no suppliers of Wendy’s ingredients reported any hand or finger injuries, the company said. Officials also have not confirmed whether the finger was cooked, as initial news reports indicated.

The Santa Clara County coroner’s office used a partial fingerprint to search for a match in an electronic database but came up empty. DNA testing is still being conducted on the finger.

Anna Ayala dropped her claim because it was attracting national scrutiny and the risk of imprisonment for perjury was a little too much for her.

IMO

I mean, HTF do you sever a finger and not know about it?

It just seems a lot less complicated when you dump steaming hot coffee in your crotch. Except now, they have all those "WARNING: Coffee can be hot!" stickers everywhere. Damned lawyers.

Doesn't this sort of repetetive behavior get jail time? I'm sure it's up to the states, but I thought I heard somewhere if a person makes repeated claims against unsuspecting companies- they can be brought to justice.

They keep looking for someone missing a finger, but I'm wondering if maybe the finger was the only identifiable body part left intact.

"Mmmm, this is some mighty good chili. What kind of meat do they use??"

But a toe in the Chili would not be very realistic. Now if it was in some wine. :p

You would think they would just call in CSI (Las Vegas) and Gil Grissom and crew would solve this pronto.

It would take less than an hour including commercial breaks. Hell, we'd know by 8:37 tonight.

I'm sure sorry he charged you for the toes, man, that totally ruins the effect. They've gotta be free or forget it. Nothing better with chili than fritos.

If there was any justice, Wendy's would file a countersuit. They won't because they don't want any publicity about this.

Frivolous lawsuits clogging America's courts. It's a crime. I hope to hell that b***h gets thrown in jail.

Hell, I am getting sued too from a MINOR fender bender. The other driver wasn't hurt !. Claims emotional distress to gouge the insurance company.

I'd be upset if I got in a car wreck and there was a NINJA in the other car. I think I'd rather hit a cop car...

This lady is a fraud, Plain and simple. Sh should be prosecuted to the fullest extent of the law. Lazy, ass bitch thinks the world owes her a living. She's a heartless bitch that attempts scams on people and for her to stoop to what she did is absolutely pathetic.

Wendy's should bring suit against her for defamation. Try to take any assets she has, and if she doesn't have any, garnish her wages.

A criminal action should also be brought against her if possible. Unfortunately, I can't think of any charges that would stick.

attempted fraud?

Possibly. I'm no criminal lawyer, but if the person hadn't gotten around to filing a lawsuit or anything, then maybe not.

I think I saw a reference that they had "filed a claim", in which case, attempted fraud would probably work.

The problem here is if this person doesn't have a criminal record, "attempted fraud" isn't exactly going to result in a helluva lot of punishment. Still worth it to put it on her record, though, so that if she ever sues anyone else, they can bring it up in court.

She should definately have her ass paraded through court, just to expose her for the fraud that she is. Then Wendy's should sue her for defamation or something and make her work for them as a fry cook or something...
