I was asked once and I don't have any clue why as I don't do anything. My response was "sorry sir but I respectfully decline."
He didn't press the issue.

Guys,

Keep in mind that if nothing is in plain sight, then officers don't have the right to search. Also, if you consent to a search, you have the right to end the search whenever you want.

Obviously, if you have marijuana or any other drug, do NOT give consent for a search. The officer will then start stalling, asking questions and snooping around. No matter what they say, do not give consent. Just say you aren't hiding anything, and want your rights respected.

They can't forcibly search it until they have a warrant. However they may be able to impound the vehicle until they get one.

yea if there is smoke pouring out the car then your fogged(unless you've smoked all the evidence and your not driving just stationary with no keys in ignition)...or even if your vehicle smells like ms. jane they have probable cause(ive had my car searched for it smelling like it)

I wasn't, dork. one was a small town speed trap and the other was a rookie claiming "defective exhaust". Both of them just excuses to search and be a hero.

Anybody ever hear that statistic that damn near half the drugs that are seized never make it to the evidence room? Where you think that s**t winds up?

i once had my truck searched. earlier in the day wed been shooting guns and id left all the ammo in the truck.

fiocci makes a clear shotshell case that apparently the cops use.

so tuff cop asks me in that mother on the fritz tone. WHERE DID YOU GET THESE! DID YOU STEAL THESE FROM A COP?

no i said i bought them at consumers hardware.

just before we got pulled over though i pitched my shit,how they didnt see it i dont know.....

I've been pulled over and/or ticketed at least 20 times in my life, and at no time, even was I was young, has a cop ever asked to search my car.

Perhaps there's something to be said for keeping one's car clean, and not looking like a f#cking dirtbag.

There's validity to that theory. When I've been pulled over alone in my tan, clean camry, I've never been asked for a search. Now my friends that drive music beatin' caddies or sticker covered saturns haven't had the same luck. I'm not saying one deserves to get searched if you drive a van with bad exhaust, but don't be surprised by it. And driving in small towns with contraband that you can't hide well is a bad idea.

I'm all for denying a search if you think they'll bust you, but be ready to spend time waiting on them to find a way to search anyway. But at least you can fight the legallity of that search.

The best advice I can give is carry a small amount and have a good place to hide it. There has to be some place where they won't look. Then, at least you have a chance of getting through a search.

And also, through the entire encounter, be totally respectful and be as cool as ice. Cussing or developing a stutter aren't good signs.

the only way they could arrest you is if you have anything on you or if you are driving or the keys are in the ignition...like i said if you are stationary and you are hot boxing your car/truck/van but you swallow the joint or blunt, what are they going to arrest you for?

trust me ive been in a similar situation before

Say no. If they use it anyway, and the local laws allow it without probable cause, at least you tried. If they didn't have the right to use it and used it anyway, with a good lawyer you will get off. It may cost more than a pot or pipe fine, but at least you got to stick it to the man.

I made a post in KC Fish's pot bust thread about an expierence I had when the cops detained us until a dog got there which was unlawful. Typically, if they already have the dog there, I think you're screwed. It's all about what your state laws regarding it says.

Sorry but if you decline a search they CAN"T arrest you or impound your car. They will call for a K9 unit and have the dog check out the car. If it barks-all bets are off. If not, they will let you go on your way.

I was asked and I said "F#ck No, you had no reason to pull me over in the first place!"

After the K9 unit left he wrote me a warning for improper lane change even though I just pulled out of a parking lot and was stopped at a red light. Cops are such d#cks-FIGHT THE POWER!!

It's funny that neither of the cops I told no gave me a ticket. It's pretty obvious they were just looking for somebody to hassle.

hahaha i wish they used a drug dog on my old car, the dog would of went absolutely crazy at the head rests. my friends and i use to blow shotties out of them. those things smelled so bad. could i have gotten arrested for the marijuana residue left behind on them?

The best way to deter the cops from wanting to search each and every car they stop would be to give them something to lose. If they search and find nothing they should have to pay you $1000. Because if they find even a little pot it will cost you that much. The way it is now they just walk away if they are wrong.

That's a novel idea, but if that were the case any search would come up with a dime bag. I'd rather they stop fining or arresting ppl for small amounts of pot. Or better yet, any amount.

The magic words...say them with me...

"I do not give consent to the search of this vehicle or any of the contents of this vehicle. Am I free to go?"

If the officer believes he has probable cause to believe unlawful activity is occurring, he can search your car on the spot, without your consent.

Commonly, officers will say something along the lines of "I'm going to need to search your car." Don't say "OK", which can be interpreted as consent. Another favorite is "Do you mind if I search your vehicle?" Both "yes" and "no" can be interpreted as consent. Say something along the lines of "I do not consent to the search of this vehicle. Are you searching this vehicle without my consent?"

Don't attempt to physically interfere with the search of the vehicle. They can bring out the dogs without your consent. Keep an eye on the clock. Most departments don't have a K-9 unit on 24 hour standby and will just come back after having you sit for 20 minutes and suggest that "we can hurry things along if you just let me search right now?" Just repeat the "I do not consent to the search of this vehicle. What time will the dogs arrive?"

When I was a teen, I used to keep my pot underneath my headrest. I'd lift the headrest up, roll up the bag, place it underneath the headrest, and then clamp it down.

They never ever found my weed. Of course, I've never had my car searched either.

One thing you might try is to keep a skunk in your van and poke it with a stick every day or two to keep the smell fresh. That way, when the officer pulls you over, not only will he NOT want to search your van, you will have an excuse for the red eyes. If by chance he does want to press the issue, ask him if, while he's searching, if he finds that skunk that keeps hiding under the pile of tools just out of reach you'd appreciate it if he'd remove it for you.

This is not real legal advice but as far as I understand it, if they pull you over, you and everything in the car is subject to search. Especially if they had anything like a credible reason for the stop(and mostly that is on the officer's word). There are exceptions of course, that's why you get a real attorney.

I did some searching on the Internet (damn, I love the Internet) and it would seem that the above statement is incorrect. I found a number of interesting appeal court decisions that are worth reading. A number of people have already contradicted me but for something like this I thought it was worth pointing out I was wrong.

Bottom line is, if you get stopped and they think you have it and you do, then dont go on a board asking for help, call a lawyer, or just man up. The stuff is illegal for a reason and if you are driving and smoking pot you deserve whatever you get..IMHO...

I never asked unless I suspected something, even then I wouldn't press the issue. Thoughts to keep in mind, and I only share this with you because you are chiefs fans......

Cops can search your car if they see any type of paraphernalia, something tangible that they can articulate in a report, and they can search it without pemission. ie probable cause. But I would always still ask at that point to see what the driver would say.

Second point to remember, if the offense is an arrestable offense, and the cop is deciding to arrest you, he's going to search you vehicle for inventory - insurance purposes anyway. Sometimes, in my case and some like me, we want to see if you'll be honest with us, the more honest you are, the better treatment you'll likely get.

final point; for any good cop, like me, there are probably three dick head cops also. See video in above clip

Police dog barking after sniffing your car is probable cause, you're ****ed. They usually only do that when they believe they already have probable cause and are just looking to to make it iron clad to stand up in court. That would usually come after something like smelling weed in your car. I am sure they would do also if they are dealing with hella sketchy people.
