Senate Democrats ie communists yesterday voted to empower unelected, unaccountable bureaucrats at the Environmental Protection Agency (EPA), trial lawyers and activist judges to enact Obama’s cap and trade national energy tax through regulation and against the will of the American people.

Voting down Sen. Lisa Murkowski’s (R-Ak.) resolution of disapproval (S.J. Res.26) by a 47-53 margin, Democrats approved handing the EPA the unprecedented power to drastically regulate carbon dioxide, the very substance human beings exhale when we breathe.

All Republicans voted in favor of the disapproval resolution that would have stripped the EPA’s ability to enforce their “endangerment” finding, six Democrats crossed over to vote with Republicans.

It is patently retarded to allow the EPA to regulate GHGs under the Clean Air Act. Best case scenario under the CAA EPA has to regulate emission sources over 250 tons CO2 equivalent/yr...which pretty much means everything. As a result the EPA is trying to issue a "tailoring rule" to the CAA allowing EPA to revise the minimum to 25,000 tons CO2e/yr under the premise that the SCOTUS ruling allows EPA the wiggle room to implement a rule that meets two requirements:

1. Administrative necessity-in short, this means can the oversight agency effectively manage the paperwork, rules, enforcement and regulation of the rule

2. Absurd results-will implementing the law yield absurd results? In this case, yes.

EPA is banking that nobody will challenge the tailoring rule because if they do the CAA mandates that EPA move forward to implement the law at the 250 tons/yr limit (again best case scenario) pending a final ruling on whatever legal challenge may arise.

Subsequently, EPA has revised their tailoring rule proposal to raise the minimum level for reporting to 75,000 tons CO2e/yr. Again, the fact that EPA itself is struggling so mightily and so readily accepts the premise that utilizing the CAA as written yields absurd results and that there is no way to effectively implement the law as written tells you all you need to know about the intelligence behind using the CAA in this manner.

Yesterday's debate from opponents focused on pretty much everything but the truth of the matter at hand. The resolution in no way rewrites the CAA, it in no way prevents Congress from passing a future law with respect to emissions. It was simply an effort by Congress to act as an effective check to the epic retardery of the Obama administration in pursuing this course of action.

But is O retarded? Short answer no. Does he, his supporters, the progressive left or the environmental movement really give two shits about your job, your career, your ability to pay the bills and provide for your family? Not one f'ing iota if you don't:

1. Belong to a union
2. Belong to a union

This administration and its zealots doesn't care a wit if using EPA to hammer the economy because it is purely a political tactic. They hope that this will eventually scare the business community into making the Faustian deal, that business and supporters of a strong economy will blink first in the best interests of their constituents and Americans at large because they will correctly recognize that whatever legislation gets passed will be infinitely better than falling under the CAA/EPA economic/environmental regime. So who is looking out for families? Not Barry O, he's using the impending anguish of the American economy at large as his whip hand to force through another destructive policy measure. It is f'ing disgusting.

EPA Poised to Throw 800,000 Out of Work

Our liberal rulers are doing everything they can about the jobs situation — that is, everything they can to make it worse.

The top Republican on a Senate environmental panel released a scathing report Tuesday that he contends shows that the Environmental Protection Agency's new proposed rule on cleaning up boilers nationwide could devastate America's manufacturing base and imperil hundreds of thousands of jobs without providing any real public health or environmental benefits.
In June, the EPA issued a proposal that would force industrial, commercial and institutional boilers and heaters to use "maximum achievable control technology" to reduce harmful emissions that erode air quality and pose a public health risk.
The proposed rule covers industrial boilers used in manufacturing, processing, mining, refining and commercial boilers used in malls, laundries, apartments, restaurants and hotels, the report from Sen. James Inhofe of Oklahoma reads.
The EPA claims this will save us from all manner of poisons and diseases. Others say that the only significant effects will be economic — and they will be severe.

[T]he Inhofe report — written by the Senate Environment and Public Works minority staff titled and titled "EPA's Anti-Industrial Policy: Threatening Jobs and America's Manufacturing Base," — found that the proposed rule, known as "Boiler MACT," could put nearly 800,000 jobs at risk over requirements on commercial and industrial boilers, cement plans and ozone standards.
The standards the EPA wants to impose are so unnecessarily stringent that meeting them would be extravagantly expensive. According to the report, the Industrial Energy Consumers of America is "enormously concerned that the high costs of this proposed rule will leave companies no recourse but to shut down the entire facility, not just the boiler."

That's fine with our rulers. According to their ideology, the less economically productive activity, the happier the polar bears. More importantly, the more people are deliberately thrown out of work, the more will think they need a free crutch from the very government that broke their legs.

The boiler bushwhack is only part of our government's war on prosperity:

The report also warned that the agency in the coming months is expected to propose, and in some cases finalize, job-killing standards for cooling water intake structures at power plants; national ambient air quality for dust and particulate matter; and maximum achievable control technologies for coal-fired power plants.
"In short, the cumulative effect of EPA's air rules will negatively affect growth energy prices, jobs, innovation and domestic manufacturing competitiveness," the report reads.
Good thing we can vote these lunatics out of office in November. But wait: the EPA is composed of unelected bureaucrats.

This is why the most intolerably destructive aspects of the Obama agenda — Cap & Tax, amnesty for illegal aliens — are not being pursued by elected representatives anymore, but are being imposed quietly by faceless, unaccountable regulators.

As for the Regulator in Chief, who we can't get at through the polls until he's had another two years to collapse the economy:

President Obama repeated in an interview released Tuesday that energy policy remains one of his top priorities, and he will throw the weight of his office behind energy policy regulations in the same way he did for the new health care law.
"We're going to stay on this because it is good for our economy, it's good for our national security and, ultimately, it's good for our environment," the president is quoted saying in the Tiger Beat Rolling Stone magazine interview.
It will be the work of generations to undo the bureaucratic behemoth Obama is building up into something that would make Godzilla turn tail and run — assuming America lasts that long.
