Shelton worked with special-needs students at North Buncombe High School.

Shelton and the victim, who was not a student of hers, allegedly had sex on April 1, 2006. If they had waited two months until he graduated, no charges would have been filed, said a detective investigating the case.

I think you need to understand Special Needs a little better. Age of consent doesn't apply when you have a mentally disabled adult, especially if they are still a student.

Age of consent does apply even if the person has an intellectual/developmental disability. The fact that the person may of been in a school transition program could be the mitigating factor. In many states, a teacher having sex with a student in high school or below regardless of age is cause for legal intervention.
