This isn't even a birther case. Well, not primarily anyway, Orly Taitz is making the side-argument, which has no chance at all, that the birth certificate was a forgery, but this case is primarily about whether both parents have to be citizens to be natural born (they don't, the crazies are wrong).

There are no documents for Obama to produce.

regarding this quirky Georgia issue:

Georgia law says that when someone challenges the eligibility of a candidate, the secretary of state must refer it to an administrative hearing. Obama's lawyers tried to suggest that he didn't have to and could have turned the challenge down, but GA lawyers seem to agree that's wrong, the SOS has no discretion at all, even when the challenge is clearly crazy.

The judge is not making the decision whether Obama should be on the ballot. His role is to investigate the facts of the issue and merely make a recommendation to the SOS. The judge has indicated that he may recommend that Obama be left off, not because he evaluated the merits of the argument and agreed with it, but just by default because Obama's lawyer wont show up to refute anything. (and he probably shouldn't, Orly Taitz and idiots like her shouldn't be elevated)

At that point, the GA SOS, having fulfilled his legal duty to let the challenger have a hearing, can say "thank you very much, judge. I disagree with your recommendation. Obama stays on the ballot." So, this administrative hearing means nothing. It is the GA SOS's call.

If he instead chooses to remove Obama from the ballot, it gets instantly appealed to federal court, who will swiftly overturn that decision.

After everything's done, Orly Taitz will resume her whining and crying about this vast conspiracy to protect Obama from claims of being an illegitimate president.

My understanding based on the coverage here in GA is that this case is about the future and not today. There's a lot of folks from both sides of the isle that really want to see it proceed so there will never be another birther type controversy again.

A few names I have heard thrown out are Jindal and Rubio as reasons this case is good...FWIW

If we're hell-bent on forcing the supreme court to decide this, that probably would have been ideal. The VP does virtually nothing, and if the supreme court ultimately tossed him out (yeah right, the 14th amendment and US v Wong Kim Ark say otherwise), then the president gets to send a nominee to the senate for VP.

Well, it looks like Obama will probably forego GA's 12 electoral votes for this upcoming election to avoid 'the obvious'. However, there are 6 other states waiting in the wings watching the GA outcome and more states may follow. And of course this decision from the judge will not be covered 'initially' by the Marxist Media:roll eyes: But as this gains traction(and it will) the Marxist Media will call this judge a 'rogue racist judge'.

Like Nixon, Obama thinks he is above the law and will begin the Nixon dance of avoidance. The only difference which is a HUGE difference is that the "Press" at the time whether conservative or liberal went after Nixon hard(as they should have), whereas today since the 'press' is now damn near totally Marxist and knows they put this 'usurper in office' will have to save face and totally 'go Postal' on everyone(not that they don't do this already) who supports the eventual GA outcome.

Don't be ridiculous.

#1) Obama's name will be on the ballot in Georgia.

#2) A sitting president should not be expected to rush off and attend every single stupid little lawsuit and hearing that a few crackpots file. If it actually worked and he attended, the courts would be flooded with junk lawsuits compelling the president to testify, just for giggles if nothing else.

Deputy Chief Judge Michael Malihi has rendered his judgment, breaking birther hearts all over the country: Barack Obama will remain on the 2012 primary and general election ballot in Georgia.

The judge’s written opinion all but drips with scorn for the absurd case presented to him by Orly Taitz and her colleagues:

“The Court finds the testimony of the witnesses, as well as the exhibits tendered, to be of little, if any, probative value, and thus wholly insufficient to support plaintiffs’ allegations…. None of the testifying witnesses offered persuasive testimony. Moreover, the Court finds that none of the written submissions tendered by plaintiffs have probative value. Given the unsatisfactory evidence presented by the plaintiffs, the court concludes the plaintiffs’ claims are not persuasive.”

In other words, the birthers finally got a judge to listen to their “evidence,” and even with no opposing counsel in the courtroom, the judge concluded that their case was total and complete bunk.
