Got a workman comp hearing tomorrow. I hope it goes in my favor. Please pray for me thank you.

Yes if i lose i'll most likely will run into a aids tree while drinking antifreeze. Then die in a fire.

I burned and hurt my foot when a colander full of meat and tub of grease fell on my leg and foot.

Found a shotgun in a closet, looked down the barrel to see if it was loaded, and attempted to put the gun in a secure location*. Pretty legit question of whether he was engaged in employment at the time or detoured.

*Had his own trailer, with kids, on the property. Real WT situation.

Depends on your POV...

For instance:

I was working for a car dealership in Wichita, KS many years ago when we had an ice storm.
My employer did not "Provide a Safe Working Environment" by spreading salt and sand on the walk ways.
I walked out the door, slipped and broke my knee. The only thing they had to pay for was some Advil, a few x-rays and an MRI.

Their total bill probably came to somewhere around 5 grand.

I could have sued them for negligence to the tune of 50 - 100 grand, (many ambulance chasers called me) but I did not. I wasn't looking for a free payday and I came back to work a week later and turned wrenches with a full leg brace.

I hate lawsuits. Everyone thinks they need something for nothing.

Example:

I have an employee that was walking and turned her ankle. She milked six months out of us for "Tendinitis." When she came back, I had to transfer the person that was filling in for her. He has three kids and a mortgage and unfortunately he had to take a dollar p/h pay cut. All because this useless old twat tried screwing over the system.
She's the reason my property taxes are high and I have to pay 4 bucks a gallon.

Beat this. Guy was an independent carpet salesman, threw his samples in the trunk and told his wife he was off to work. Three hours later, passers-by found his car upside down in the ditch, he and his drinking buddy both dead, he behind the wheel with a .38 BAC.

Only a preliminary judgment, but the ALJ opined in the first PHC that with the samples in the trunk and businesses in the area, he'd likely find the guy in the course and scope of his employment.

Actually, in HS, way before I knew anything about WC, I had a very similar incident. The manager made me and another employee transport the fry oil to the disposal unit by the dumpsters before it cooled. The other guy was a wuss and halfway there his arms started shaking. Some of the oil splashed on his forearm and he dropped his side and ran off screaming, spilling all the oil on my feet. I must've kicked my shoes 20 yards. Very painful. Got 2nd degree burns on both feet, had to start the school year in house slippers, and missed the first half of the soccer season.
Didn't get a cent, except for medical paid, not even temporary disability for missed work. Probably fair from a permanency standpoint, as my feet eventually healed completely. But in hindsight, I regret not pursuing something, with the negligence of asking two teenagers to carry a vat of full hot oil that far, and missing so much of my soccer season.

I'd DQ that judge in a heartbeat (if I was defense). I guess compensability depends on whether the drinking buddy was at all connected to carpet and whether he actually made any business calls in the area.

Burden of proof is a bitch for the employer.

This was in MO, where course and scope is nearly a given.

We joked about the legal standard for Carpal Tunnel compensibility being a two step analysis.

1. Do they have hands?
2. Do they have a job?

Boom! Course and Scope.

Dunno what ever happened with that particular case, I handled that one PHC. It was another partner's case, but I was covering the entire PHC docket that day [Cape Girardeau].

It's $1.99/gallon from skim to whole at select Aldi stores. I spoke with the mgr. at my store and he said the KC area source for milk is either Roberts or Belfonte.

Maybe he did all of these and he's immune to the pollen from the aids tree, the sweet taste of antifreeze, and he's already shown that heat can't phase him.
