Shutting down the Emporia plant. The Emporia gazette said there were 400 people working there. Pretty tough for the town. In the last decade or so the town of 30,000 ish has lost Modine, IBP and Dolly Madison.

I think they picked up another dog food plant, but that town has to be hurting.

Awesome. What better way to pay back unions. You don't have a job, now go **** yourself.

Hooray for private equity firms who bought the company, loaded it up with debt and told the workers that they weren't going to honor their contract.

What kind of cuts were the workers talking about?

"But if I have to take the cuts they're talking about I can get more from unemployment."

http://articles.chicagotribune.com/2012-11-15/news/ch-twinkies-hostess-wonder-bread-strike_1_workers-at-hostess-plants-twinkies-maker-hostess-hostess-brands

So let me get this straight...a private equity firm comes in and tells workers that if they want to keep working they have to make less money than they would get if they didn't work at all? And now somehow the people in a union saying, "screw that" are the bad guys?

Awesome. What better way to pay back Republican Zomnies. Your tax dollars are paying for their unemployment because you can't do math, now go **** yourself.

They may take home more with unemployment, but taxes and social security aren't withheld. Come April, they will owe taxes on all that unemployment money.

And then there's the issue of unemployment being a finite benefit.

I think it would be interesting to see what kind of concessions the unions had already made in the past. Right now, I think they are looking at an 8% cut.

jspchief
11-16-2012, 07:56 AM
Unemployment benefits typically pay about 66% of the average of your gross income over the previous X number of weeks. Your take home pay from a job is probably in the neighborhood of 75% of gross.

Take an 8% pay cut, and your take home pay may come close to that 66% unemployment benefit.

But like I said, taxes are not withheld from unemployment, but they are still owed on it. Short term you may be bringing home more collecting unemployment. Long term you won't. And it will run out.

Alright I am on the union side now if this true.

They watched as the company illegally withdrew from all Taft-Hartley pension plans, saving more than $50 million in the first five months. The BCTGM learned that the then Hostess CEO was to be awarded a 300% raise, and at least nine other top executives were to receive raises ranging between 35% and 80%.

Since the company ceased making contractually obligated payments to the Hostess workers' pensions in July 2011, it has pocketed approximately $160 million – money earned by and owed to its dedicated workforce.

The contract calls for extreme wage and benefit cuts which amount to 27- 32% overall, with an 8% wage reduction imposed immediately. The company unilaterally ceased making contributions, required by their union contracts, to the workers' pensions in July 2011. Hostess has also imposed draconian cuts in health benefits and eliminated the eight-hour workday.

This is a prime example why the new "normal" unemployment rate is going to be 6-7%, not the 3-4% that we have previously been used to. Low-income workers are going to be more content to just say f#ck it and take unemployment for years on end instead of taking less to keep an undesirable job.

Our welfare system essentially incentivizes this attitude, and US taxpayers will pay for it.

So Twinkies can survive a nuclear holocaust, but not a second Obama administration? Hmmm

This is obviously what the new company will do.

Thanks Brock.
It seems the only way to go but I'm not aware if there are legal implications in terms of breaking a bargaining unit in this manner.

I went out yesterday and bought a couple packs of Twinkies, some blueberry mini muffins, and a hostess apple pie. I ate one 2 pack of the Twinkies and regretted the purchase.

I'm pretty confident those well known products and product names will be bought out of bankruptcy by another bakery company and marketed and sold by them. Doubt you've seen your last Twinkie.

You'd also be surprised at the extent of their private label business. It will be interesting to see who picks up that million miles of slack... if it's possible.

Hostess CEO Greg Rayburn said in an interview that there was no buyer waiting to buy the company. But without giving details, he said that there has been interest in some of its 30 brands, which include Dolly Madison, Drake's and Nature's Pride snacks.

Now that I think about it, I can't remember the last time I actually bought any Hostess products. I quit buying Wonder Bread years ago because it seems to get moldy within a couple of days. I laid off Zingers and Twinkies and the Snoopy donuts a long time ago, too.

I guess in the end this really won't impact me much.

Do people really think that the bakers striking for a week is what killed this company?

bigbucks24

:D

I hope not.
As others have said, I can't see these brands going away even for a day. Hell, who knows? The union may straighten out and accept the new terms.

What is the legal reason the company can't shitcan the union workers and hire them or anyone else as non-union under a bk then re-org? Anyone?

They have lost quite a bit of business over this. Many restaurants use Hostess/Wonder/IBC for their buns. They have now switched and most likely, won't switch back.

I just started reading this thread and saw this and decided to comment on this.

I worked for IBC-Wonder-Hostess for 3 1/2 years.

Dolly Madison management manage that company to extinction, and went they went out business, thsy sold off some of their operation and product labels to IBC.

IBC, in their infinite wisdom, decided to bring those same dumbasses that managed Dolly Madison into extinction into the business and let them run the bakery and distribution operations.

As a vacation relief driver, I was moved from depot to depot to fill in where needed.

I worked in several locations from LA to Bakersfield and every place in between.

The bakery overbaked so much product that each depot would have in the neighborhood of a hundred grand of product at the end of the week, every week, that never left the depot.

Dumbasses in charge are telling you that it's because of the workers and strikes, but the reality is the dumbasses in charge are responsible for the end of business.

They went through 3 prior bankruptcies and the bakers going on strike for a week is what did them in? I think that's just a little bit hard to believe. And if that is the case, what was going on that a week of not shipping product was enough to totally topple the company?

I'm not doubting that management made dumb decisions. But that doesn't change the fact that 18500 people are out of work now because a few union fuckholes decided it would be cool to kill the company.

Everybody knows the management was not good and a lot of the reason the company was in trouble.

But that doesn't mean that union workers deserve more money than the company can afford?

That's the beauty of the freemarket system. Those workers could have tried to find another job. And if that's the best they could get, then they should take what they could get from DM.

What is the legal reason the company can't shitcan the union workers and hire them or anyone else as non-union under a bk then re-org? Anyone?

There is probably language in the contract(s) that says anyone who buys it accepts the terms and conditions of the contract(s).

This is a sad tale of unmet desire. Upon learning of, then contemplating upon, this sad news, I came to realize a great truth; I am not prepared to never again eat of the Twinkie cake for the rest of my life.

Therefore, I went to the grocery last night. As luck would have it, they were running a "buy 1, get 1" special on Twinkie cakes. Needless to say, they were sold out and so was the quick market I stopped in on the way home.

This is not looking good.

Good to hear, Mr. Dave. Real good.

You know, the Twinkie cake has been around since the year after the Buffalo Bisons set the record for most games without a lead (until we did it, of course). That's a long time and an America without the Twinkie cake just wouldn't be the same.

The funny thing is, though ... I don't really eat a lot of Twinkie cakes. In fact, I don't think I've had one for probably 10 years or more. But, when I learned that I was going cold Twinkie not out of choice, but out of necessity, I wanted a Twinkie cake pretty darn bad.

They say that there's a company in Canada that makes Twinkie cakes, so maybe they can start selling on e-bay, or something.

It’s a golden opportunity.

Hostess Brands is going out of business and it’s possible the company’s most iconic sugary confection – Twinkies -- could be bought by a Mexican business.

Mexico’s Grupo Bimbo, the world's largest bread-baking firm, could be on the short list for acquiring some of the Texas-based Hostess’ foodstuffs, according to Forbes. Grupo Bimbo already owns parts of Sara Lee, Entenmann’s and Thomas English Muffins.

Other firms that could be in the running include ConAgra and Flowers Food, the American company behind Nature Valley granola, as well as McKee Foods, baker of Little Debbie snack cakes, the Christian Science Monitor reports.

Pepperidge Farm, a division of Campbell Soup Co., is also considered a prospective buyer, analysts told Fox Business.

The Monitor reports Bimbo has already been present around the bankruptcy proceedings that have haunted Hostess for a decade, in a bid to further expand its North American portfolio and pad its $4 billion net worth.

According to Forbes, Bimbo put in a low-ball bid of $580 million a few years ago. But Hostess may turn out to be a steal with a reported worth of $135 million today.

The Hostess brands “most likely will be purchased by a competitor that will bolt the additional sales to a more efficient delivery system,” David Pauker, a food industry restructuring specialist, tells Reuters. “The company itself won't survive.”

Daniel Servitje Montull runs Grupo Bimbo along with his family. Under his leadership, which began in 1997, Daniel Servitje positioned the company for rapid growth. This included a battle with Mexico’s tortilla king and bringing white bread to Latin American markets, according to Forbes.

Today Bimbo, which reportedly competes with U.S. companies like Kellogg, Hershey and General Mills, is a $10 billion sales business with $200 million cash on its balance sheet, according to Forbes.

That’s a lot of Twinkies.

Amazed this didn't get posted. I will post it without comment and let you all fight it out.

A federal bankruptcy judge has approved bonuses for executives of Hostess, the maker of Twinkies, who stay on as the company is broken up and sold off.

On Thursday, as part of a plan to liquidate the company and lay off 18,000 workers, a federal judge in White Plains, N.Y., approved paying 19 Hostess executives bonuses totaling $1.8 million. Hostess has said it has interest from at least 110 firms who want to buy pieces of the operation.

The decision comes as the company, known for its iconic snack cakes like Ho Hos and Ding Dongs, says it doesn't have enough cash on hand to pay retirement benefits to some former employees.

The bonuses do not include pay for CEO Gregory Rayburn, who was brought on as a restructuring expert earlier this year, according to The Associated Press. Rayburn is being paid $125,000 a month.

Former employees are outraged over the bonuses handed out to high ups.
"Anybody's got a reason to be upset who lost their job if there handing out large amounts of money," Paul Carroll told ABC News.

In a statement overnight, Hostess said the bonuses are designed to keep top brass from leaving before winding down what's left of the company "quickly and cost-effectively."

"I was qualified to draw my pension, with no notice I lost about 70 or 75 percent of it I didn't work 34 years to lose it," Carroll said.

Hostess was given interim approval for its wind-down last week, which gave the company the legal protection to immediately fire 15,000 union workers. Hostess said last week it will retain about 3,200 employees "to assist with the initial phase of the wind-down," which is expected to last about a year.

So, they are taking money that is owed to the workers and giving it to the executives before the ship sinks all the way to the bottom?

WOW. Straight up corporate theft right there.

They're paying people to do a job. They're going to stop paying people who aren't doing a job anymore.

Only the middle class people working in a union are greedy. Executives making 20-50 times what the regular hourly employee of the company are somehow not considered greedy.

They are also not paying pensions that they owe.

Yeah, that definitely sucks, but that happens in bankruptcy situations. If they don't keep people around to wind up the business, even fewer of the creditors will get paid because the liquidation will be less likely to get top dollar.

Agreed.

That being said, do you agree that it is beyond ridiculous to keep a guy on to "wind up the business" at 125,000/month while 30+ year workers get fucked out of their pensions?

In bankruptcy the only people to truly get paid are:

Secured Creditors
Attorneys
CPA/Accountants hired for Forensic Account purposes
Employees who wind down the business
"Experts" in bankruptcy wind-down operations (Usually these are the experts who know how to maximize value of the bankruptcy estate)

Everyone else takes a haircut....some get a slight trim, others get it all taken off the top.

They're paying people to do a job. They're going to stop paying people who aren't doing a job anymore. They worked for 30 years to get that pension. Now what are they going to live on?.....unemployment and the taxpayer dime. While the executive gets a 300K raise and the junior executives get raises for the fantastic job they did running it into the ground.

You see nothing wrong with this picture?

How easy is it to find a cheaper alternative and what were the terms of the guy's compensation before the decision to shut down and sell off?

If the judge who has all the information approves it, why should I come to a different conclusion based on almost no information?

Though it sounds awful and I don't blame the workers for being pissed, I agree with pat on this one. If you literally just fold up shop, there's even less money in the company to pay off debts and salvage whatever they can of those workers' pensions. It sounds like a lot of money to me for sure, but if they think they can save $200k per month by paying that guy $150k per month, they're making positive progress for everyone even if it doesn't seem that way.

Yeah, I guess there's not much more to do. I guess this is cheaper than paying a receivership to handle this (or maybe receiverships do not make those kinds of decisions).

Or, I will volunteer to do the job for 140K per month, and I will follow all the judge's decisions for who has priority of the remaining assets.
