Lawfare posted this a day or two ago.

It's a rare peek inside the facility. Confirms most of what we know already, of course, but you never get to hear these people say anything about the conditions because they legally aren't permitted.

It's a PDF, otherwise I'd post -- but it's 4 pages long and an easy read.

Read it here (http://www.lawfareblog.com/wp-content/uploads/2013/05/Attachment_Obaidullah-Declaration-1.pdf).

Obaydullah on the Hunger Strike

In March, Obaydullah, a Guantanamo detainee, signed this declaration (http://www.lawfareblog.com/wp-content/uploads/2013/05/Attachment_Obaidullah-Declaration-1.pdf). It evidently was intended for filing in federal court—in connection with the Al-Madhwani emergency (http://www.lawfareblog.com/2013/04/developments-in-gtmo-emergency-motion-on-water-and-cold/) motion (http://www.lawfareblog.com/2013/04/district-court-no-jurisdiction-over-emergency-gtmo-motion-on-water-cold/)—but ultimately wasn’t filed, for timing reasons.

The document was made available this week, and describes Obaydullah’s participation in the hunger strike at the detention facility, and the conditions of his confinement.

I read it. I found nothing interesting about Obaydullah's story. His complaints about poor health and weight loss could be easily remedied if he ends his hunger strike. His complaints about searches and mild distractions during prayer time sound trivial to me. I guess you'll complain about anything when you don't have much. No sympathy here.

It does re-raise the question that these folks deserve legal recourse.

Dehumanizing prisoners with no legal charges, and many of them have been found as not guilty.

They already have legal recourse.

They are no legal charges because they aren't incarcerated for violating the law.

Did they think a concentration camp was going to be fun?

Describe it to me.

The Supreme Court, incorrectly IMO, decided that Guantanama prisoners must be allowed to challenge their detention in US federal court. Many have taken advantage of this opportunity.

And what happens if the government declares that they have committed no wrongdoing?

I don't know that that has happened. There have been some detainees who have been cleared for release, but for one reason or another remain in custody. If they are being wrongfully detained though, they should file a habeas corpus writ.

And there you have it.

I think they should maintain their hunger strike indefinitely.
