If I was AP's lawyer, I would argue that for it to rise to a felony level the injuries had to be "serious in nature"...And that these injuries are minor, and not 'serious' injuries that would make for a felony....

I am not up on criminal law enough to know the real answer, but thats about the only defense I can think of currently...other than faked pictures/texts

Nor am I claiming these injuries are (or are not) serious...Just stating a possible defense
