It will be something like... plead guilty, prosecutor will recommend a sentence of (agreed upon term, likely 8-10 years would be my somewhat informed guess), and the judge will LIKELY follow the prosecutor's recommendation.

^ sometimes that sentence recommendation will be based on sentencing data from similar cases in the jurisdiction under current statutes.

If Ruggs' drug test comes back showing he was over the legal alcohol limit or - even worse - was under the influence of drugs... that offer is not going to be a sweetheart deal.

I suspect the team knows the results of the drug test and they're not positive for Ruggs, or would not have released him already.

If the defense team can create any issues with the impairment side of the argument, they may be able to get the prosecution to work with them on a reckless driving conviction instead and then work within that framework on a sentencing deal.

But yeah, if that was done well and comes back at 3 times the legal limit and/or high, his lawyers are gonna have a hell of a tough time with negotiations there. As has been noted, Clark County can be rough sledding because the last thing they want is tourists treating their town like its Sodom. If high profile cases like this end up with slaps on the wrist, it's just going to encourage more reckless behavior.

If she didn't die, initially, from Ruggs rear ending her...but actually from her vehicle catching fire and not being able to open her doors?

I'm not trying spin this...and why I brought up a Hummer as an extreme example.

Would she still be alive in a different vehicle?

If the car didn't catch fire...then the accident still happened, media talks about it for 24 hours... and Ruggs gets suspended.

Legally it will make no impact. You probably can't even introduce the line of questioning at a trial.

There are all sorts of 'take the victim as you find them' kind of analysis here. What if it was a male driver with bodybuilder strength who could've forced his way out of the flaming vehicle? Don't know and the law doesn't care. You don't get to presume that.

Is it a reasonably foreseeable consequence of driving a car at high speeds into another car that the other car would catch fire? Yup. I don't even see grounds for arguing that. So in that case, there's no superseding cause or unforeseeable effect and Ruggs can't try to make the argument that a more 'robust' vehicle would've taken the impact better.

No. In Nevada defendants who are charged with a crime have the constitutional right to a jury trial only if they are facing more than six (6) months in jail. Also, people charged with misdemeanor battery domestic violence in Nevada may have a jury trial.

Otherwise they are entitled to a Nevada “bench trial”, where their case is heard and decided by a judge rather than a jury.

What is a Jury in Las Vegas, Nevada?
A jury (formally called a “petit jury”) is a group of local citizens in Nevada called upon to sit through a trial and then deliver a verdict. Juries may be used to determine not only the defendant’s guilt or innocence but also, if necessary, the final sentence.

So you think that your pervert showing of the faces of death video of someone being burned to death is bad evidence for the defendant to have played to a jury and that defendant requests a jury trial and lets it into evidence? You sure are wise.

I guess you and whoever wants to circulate the pervert video has to do the okie doke and play your pervert video by pointing the finger at Ruggs when playing it so that it is not just playing a video of someone burning to death.

If you want to play faces of death videos of people burning to death, just have your jollies without coming up with some bullshit "reason" for getting your jollies.

It is a disgrace that someone took that video and does anything other than give it to the police. You and the stupid ass website passing it along is as shitty a thing to do.

Depending on how long he's in jail/prison, some NFL team will probably sign him when he gets out.

They did with Vick, they will with him as well, unless he gets the max 20 year punishment.

That's actually pretty common. Case law has refined the right to a jury trial to apply to 'serious offenses' only. And most jurisdictions hold that to be 6+ months in prison (though certain kinds of significant fines could theoretically trigger it).

And in most states, a sentencing hearing is conducted by the judge rather than a jury (though my memory is that capital cases are decided by the jury).

So theoretically, if Ruggs plead no contest, he could skip straight to a sentencing hearing and avoid a jury outright. But at the sentencing hearing the prosecutor may still show a video like that in arguing for a harsher sentence and it could easily sway a judge.

Given how extreme the accident was, the guy could be found guilty of reckless driving resulting in a fatality even IF they can't establish he was impaired. And he would likely still end up with jail time for that. His attorneys would probably be wise to get a plea deal worked out and hope he can get 2-4 years in the poke. Let's say he pleas and gets 4 years - he would be out at 27. If he's still in shape, he'd probably need a year or so to get back into football condition but he could be ready to take a stab at a return at 28 years old.

With his speed, he could probably still stick around until 30-32 yrs old. That's a potential 4+ year career and enough time to re-create some semblance of a life going forward.

I really don't think he wants to go to the mattresses here. That puts some seriously ominous outcomes on the table for him.

Yeah I was responding to Jettio who like Blackop is a clueless online lawyer

If Ruggs spends any considerable amount of time in prison I cant imagine him being allowed back into the league actually playing. I'm trying to think of a player who spent multiple years in prison and came back to play in the league.
