I feel bad for that security guard. He did what he could, but he might carry some survivor’s guilt. And if he doesn’t, that’s still a damn traumatic thing to witness.

Someone mentioned ankle bracelet and saw a mention of a breathalyzer... no idea if either of those are confirmed release conditions.

They're probably looking at months for this to get through court, so in that regard it's not a big surprise to not have him locked up for all that time (technically, I think he'd get credit for time served if he didn't make bail, but then you would have to assume he'll see any jail time).

I think that I saw a charge of recklessness causing death (which certainly would be justified here without the DUI) would be 2-5 years.

Heard some attorney on the radio talking about this and he believes this will never go to court. Even the high priced defense attorney won't like this case and the family won't want all the details stretching out for months and months. Both sides will talk behind closed doors and settle as quietly as possible. Ruggs will do his time but still not likely to go to court. Will civil cases come up later? Maybe...

Most jurisdictions recognize a 2nd degree murder charge for conduct that demonstrates reckless indifference to life and in the process leads to a foreseeable death.

It's sometimes called depraved or wanton heart murder.

Man, if this doesn't qualify, I'm not sure what does.

Not sure if Vegas recognizes it or if the penalties for it are any different than the 2-20 under the DUI/Homicide charge he's been hit with.

In either event, it really kicks the legs out from under the defense's stool here. Typically you'll see them attack anything that would've spoken to his intoxication. The administration of the tests, chain of custody, etc.... Things that would call into question the admissibility of the evidence and/or its reliability.

I just don't know that it matters much here. Drunk or not, 127 in a residential neighborhood is about as 'reckless and indifferent' as it gets.
