Conjecture is that they're Skrulls that are called something else because the studio doesn't have the license to use the name "skrull" (that was part of the Fantastic Four license apparently).

The Avengers Won’t Battle Skrulls or Kree, Joss Whedon Says

Captain America and his superhero team won’t be squaring off against the Skrulls or the Kree in The Avengers, said director Joss Whedon, ending months of fanboy speculation about the identity of Loki’s evil minions in the upcoming flick.

“I will say only this: It is not the Kree or the Skrulls,” he said Saturday after cracking a joke about Vulcans during his talk at South by Southwest in Austin, Texas.

“Those two aliens are Marvel mainstays and have enormous backstories,” Whedon said, as reported by EW.com. “They have a big life of their own that just could not be contained in a film where I already had seven movie stars.”

Thor’s magical brother Loki is the movie’s main villain, but the character alludes to having an army at his beck and call in the most recent Avengers trailer (above), fueling speculation about who he might be commanding. Whedon said he didn’t want people to be disappointed in theaters if they showed up expecting some of Marvel Comics’ more well-known alien baddies.

“The Skrulls — they can shape change,” he said. “That’s a whole thing I’ve already got Loki. He’s got magic. Once you got magic along with your Iron Man and your Black Widow — it’s a real juggling act.”

Ok .. here is my guess on the alien army... I am guessing they are genetically altered Korbinites (whose homeworld was wiped out by Surtur so they are looking for a new home) AND at some point towards the end... we will get a hint leading to Beta Ray Bill who will show up in Thor 2! That would be a really badass idea.

Only problem with this theory... they aren't orange like they should be.

That could be cool. It would also fit Marvels m.o. They're always giving little nerd shoutouts and setting up the appearance of new characters in other films.
