How difficult is to get a trademark on a name?
My wife is starting a small local baking business and wanted to get it trademarked. How difficult of a process is this? It's not going to be a big elaborate production, but just something to protect us should someone try to use the same name.
Any help is greatly appreciated. |

I doubt it's too hard at all, I wouldn't think there's many requirements or anything. But I really have no idea I'm just guessing.

My sister did it and said it wasn't that big of deal. She went to a lawyer that specialized in trademarks and patents, paid the fee and was done. Sorry I don't remember what she said it cost her.

The process to trademark a name is very similar to the process of copyrighting a name. Just ask Lisa Henry B., mother of Curtis B. (who got slapped), for more information -- although be forewarned: She charges $3,000 per hour.

First, you should conduct a search ... I think the trademark database is called "TESS" or something similar ... online searches are available, I believe.
Then, you have to purchase a 12 pack of beers. Drink half the beers before you begin the next step as it is incredibly stupid. Then, you register the mark application. You can do this online, too ... I think. Anyhow, this is just an application, though. It may not result in the mark being actually awarded. Drink 2 more beers. Next, you pay money. The amount differs depending upon the type of mark (or class) and the number of marks ... somewhere between $250 and $500 ... if memory serves. Drink 2 more beers before you do this. Then, drink the rest of your beers and wait. It may take awhile to hear back. I don't recall if there's a method of checking on the status of your application. There may be.
