So this teacher 29 year old Kelly Ann Garcia is charged with having sex with a 16 year old female student.

It might be different state by state. Here in California you can start at 15 years, 6 months of age. You have to go through a certification process, a written test and a driving test to get your actual license. Your actual license is still provisional and there are specific rules for minors that apply until they are 18 years old.
