Arkansas state code 5-2-608 says deadly force may be used against another person if the“person reasonably believes the use of deadly physical force is necessary to prevent the commission of arson or burglary by a trespasser.” Burglary hardly sounds the same as someone “using deadly force against you”. In fact, burglary is defined in Arkansas law as:
5-39-201. Residential burglary
(a) (1) A person commits residential burglary if he or she enters or remains unlawfully in a residential occupiable structure of another person with the purpose of committing in the residential occupiable structure any offense punishable by imprisonment.
Unless they've changed the law in Arkansas since 2010, the shooter would seem to be in deep kimchi.
