Merriam Webster's definition of surveillance:

the act of carefully watching someone or something especially in order to prevent or detect a crime
I'm not going to argue over NSA semantics and definitions that they use to justify their behavior. I think what they are doing falls under the commonly interpreted definition of surveillance.
