The standards established for criminal law is meeting all the elements of the crime accused; often including the mens rea - intent.
These have changed very very little in 100s of year's from criminal acts- last codified in the 2nd restatement.

He has also listed parking truck down the street, having reading material, energy bars and water, "hiding behind bookshelves" etc. as reasons for premeditation.
If prosecutors are successful, it will more than likely be presented again.
