Thanks Kloster, I didn't know that was state law...it doesn't leave much room for the idiots in the jury...
I thought it was the judge's or prosecutor's decision...perhaps they made the mistake of seeking a capital muder conviction in the first place...maybe the should have charged him with 2nd...I've heard though, that the evidence was strong...how can a jury seemingly ingnore the testimony of the victim herself?...boggles the mind...
Once again, black or white, had it been you or me, we'd be looking at a lethal injection...what a great injustice system we have....
