A bunch of sports guys are idiots.
Heck, for the player's sake they need a promise in writing. Otherwise, if nothing's official, the NFL could say "if you form a union, we can talk", they form a union, and suddenly they gave up their antitrust lawsuits for nothing. The NFL can grin, impose the previous CBA with a "hah, gotcha suckers!", and we'll be down a deep rathole.
If I'm the players and I think we have a handshake agreement, I force the NFL to give me a promise in writing contingent on the re-forming of a union by a deadline, so that I can form the union assured that the deal's done and the NFL wont screw me.
This whole "*gasp* the NFL is coercing them to form a union!" thing is silly.
If the players don't want to unionize, they can give the NFL the finger, keep on with their lawsuit, appeal the 8th circuit to the full 8th or the supreme court, and press on for a forced end to the lockout with no CBA and total victory.
