As I read it, you have to go to the ground intending to give yourself up.
He didn't go to the ground intending to give himself up - he hit the ground trying to catch a ball then rolled over injured.
The rule itself says you "declare yourself down by falling to the ground or kneeling and making no effort to advance". That isn't what McCluster did. McCluster hurt himself and then grabbed at the injured part.
The broadcaster was wrong, McCluster was a puss and the refs actually got it right.
