I'm all for voters making that decision for themselves, as they have done in Washington state this past November and as they did the other direction in Missouri. As they're doing with pot, as they do with tax initiatives. Let the folks decide what they want. I really, really don't want the Supreme Court weighing in on this and pissing off 1/2 of the nation, enforcing an unteneble position.
They already waded (pun intended) into abortion. Had they demurred, the states would've started passing it into law anyway. I mean, even South Dakota just shot down an anti-abortion measure recently.
