This isn't really true. The fact that the Obama administration refuses to establish a rigorous process that protects the due process rights of Americans with serious limits on this practice doesn't mean that the Al-Awlaki termination couldn't fit within such a process.
For example, lets say that the process required a court order based on compelling evidence that the target is involved in ongoing terrorist acts against this country and is located in a place that American forces cannot reasonably apprehend him without some specified risk of danger to themselves. The Al-Awlaki case would easily pass this test. It's the hypothetical marginal cases where this memo creates real concern.
