but getting married is a pursuit of misery
marriage necessarily involves the government, because the government takes a role in enforcing the agreement between the two parties of the marriage contract. The government isn't just sticking its nose in because it has nothing better to do with its nose. The parties entering into every legal marriage—traditional or same-sex—invite the government into the marriage as a third party defender of the rights of each individual in the marriage.
If you don't want the government involved in marriage, there are ways around it, but relatively few people choose those paths.
BTW: The pursuit of happiness is a Declaration of Independence thing, not a Constitution thing.
