But if it is a tax, then it must originate in the House, and Roberts ignored this.
But the bill that became Obamacare DID originate in the House. The SC has ruled on situations like this before.
And besides, the Cons. refers to a bill "for raising revenue" and the SC has several times said that "for raising revenue" means that the revenue must be the main reason for the bill, and not incidental.
