I think it would be better to just say to FOX, "look, you let us use the intellectual property, you get X%. We're better than you and everybody knows it. Take the money without the expense or risk and hitch your wagon to the golden goose."
If I'm FOX I have a hard time turning that down, as long as the money is decent.
