The other thing that seems possible is that the subpoena was either directly used to gather information from an assistant or the threat of a subpoena was used to gather information from an assistant regarding the payment.
Emmert has said any information that was gathered via that sort of source is going to be excluded from the investigation.
All speculation, of course.
