As far as Joss Wheden goes, he said he used the Chitauri(sp) as his aliens in the Avengers movie instead of the Kree or the Skrulls because they had such a limited history that he wouldnt infringe on their comic history the way using other more well known alien races would have. That's probably a little bit of a stretch. As I recall, Marvel didn't even have the rights to use the Skrulls until well into post-production on the film (if they ever got them back - I think they did - either way, they were tied to the Fantastic Four franchise to which Fox owns the rights).
