What do you do? In first year torts, you read an important case Summers v. Tice, about two shooters, at least one but maybe both, hit a third hunter.

Maybe charge them all, and let them duke it out in trials as to who convincingly proves their innocence? Yes, that would be fine even one or two were definitely innocent, perhaps. Since cops have a heightened duty to protect, just charge them all.

No evidence to convict in scenario A, scenario B has enough, all officers are guilty of murder. Us vs Them and what not, seems to be the way the police officers in this country want to play the game nowadays.
