Could anyone suggest a lawyer for me

I need a good personal injury attorney. My job where I got injured is being very evasive about wanting to give me workman's comp. My injury will require therapy and possibly surgery so I need that covered I also could sue the homeowner where this happened. I'd appreciate any help from you guys.

Has anyone here ever filed a workmans comp claim?

I had an employee once who got into a car wreck and did it. It was pretty simple and I'm not sure my company did anything except sign a couple of papers. There was no incentive for us to fight anything because we already pay the insurance. Are other employers or other states different?

One of my former managers had some vertebrae in his spine broken when he was crushed by a coin cart at the casino. Back when the Missouri casinos still used coins, he was in the cage moving a cart. Well, it was loaded with all the buckets on one side, so when he tried to move it from that side, it tipped over and landed on him. He was pinned under it for about 20 minutes, since the way it fell, it blocked the security door into the cage. They had to crawl through the cashier's window to get to him. As far as I know he won the initial suit, but almost 15 years later because of the casino appealing and delaying the process, he hasn't seen a dime.

Serves him right, he should have known all those coins could fall on him...personal responsibility /Pat

I've seen an instance with a previous employer where he ended up injuring his back on the job. The company sent him to probably the cheapest (see: shittiest) doctor they could find and he signed off on him returning to work before he should of. Surprise surprise he got injured again and it was basically a never ending cycle until they fired him because he couldn't meet expectations for obvious reasons.

So you could say they rushed him back which in result screwed him out of workmans comp pay and actual pay because negligence. Obviously not every situation is going to end up like this, but I'd still suggest having some representation in place to ensure your future well-being. A lot of people are assuming everything is cut and dry and 100 percent honest. That's just not how the real world works.

Perhaps he should have sued the employee who loaded the coins wrong. Because that's where the fault lies.

It seems to me like there's a middle ground that's missing in America these days. The middle ground would be, "Wow, that's a terrible accident. We have insurance that'll get you back up on your feet."

Still the most misunderstood lawsuit in history. There is an entire documentary that debunks the public understanding of that case.

As for my personal opinion on this one. I would go through normal channels and if you are denied workman's comp, better call Saul. I wouldn't even consider the homeowner, no matter how fat, drunk and stupid you perceive them to be.

Funny you mention that. My understanding is that in the state of Missouri at that time, personal liability while performing work duties was almost nonexistent. Later on, we received notification (I believe 2010-11) that the law had been revised or repealed to shift more liability to an employee in situations such as that. At the time it happened though, it was nearly impossible to sue the individual acting as an agent of the company.

I had to take a trip to the ER when I was in college due to an accident at work. I went in the back to grab something for a customer who, of course, came in after we had closed. A shelf fell and pinned me next to some stock racks. I was able to push it off of me, but it cut my back up pretty bad and knocked a few vertebrae out of place.

I signed a few papers at work and at the hospital and that was that.

I posted an opinion. It's my fault you couldn't agree to disagree or otherwise restrain yourself. That's a shame.
