Where does it matter where he got it from? If it was ascertained that it was something off their shelf prior to the fact then that is an issue. The fact that it wasn't in any kind of packaging (as is every bb gun on the shelf at walmart here) probably didn't help his obvious intention to portray it as an airsoft gun.

From the video it says he picked up a BB gun that was being sold by Wal Mart. He didn't bring anything into the store. They pointed out that it was laying on a shelf and had been unwrapped by a previous customer.

It's the equivalent of being accused of grand theft auto for taking a test drive on a car lot. Except this guy was executed for it.
