A 16-year-old avoided spending time in prison for killing four people in a car accident in June after the judge bought his lawyers' argument that he was the victim of wealth.

CBSDFW reports that Ethan Couch was sentenced to 10 years probation for the drunk driving crash that ended the lives of youth pastor, Brian Jennings; Hollie and Shelby Boyles; and Breanna Mitchell.

Prosecutors asked that Couch serve 20 years in prison. His blood alcohol level was .24, three times the legal limit for an adult.

Psychologist G. Dick Miller testified for the defense that Couch suffered from "affluenza," a condition in which "his family felt that wealth bought privilege and there was no rational link between behavior and consequences," KHOU reported.

Miller said Couch's parents never punished him for his behavior, even when, in a separate incident, cops found him passed out in a car with a naked 14-year-old girl.

As part of his sentence, Couch will be sent to a private counseling center that costs $450,000, which will be paid for by his father.

Money and privilege has helped defendants avoid serious prison time for violent crimes before.

In a particularly clear example, cited by journalist Glenn Greenwald, hedge fund manager Martin Joel Erzinger served just 90 days in jail after driving the car that seriously injured a bicyclist and fled the scene of the accident in 2010.

The district attorney in the case charged Erzlinger with two misdemeanors instead of a felony, noting that "felony convictions have some pretty serious job implications for someone in Mr. Erzinger's profession."

In a just world, yes. But can they be sued? On the one hand the defense is essentially "it's the parents fault" but can't the parents just say, "We didn't know he was drinking and driving at the time."

Yes. Wrongful death. The kid is a minor so the parents are responsible.

If that's a fact, ok. Just, I've rarely heard of parents being held accountable for their child's crime. Although, it makes a ton of sense when they defend him with "we made him this way.'

The judge had financial statements that guided his decision? Or was the prosecutor a totally incompetent **** up? Lets blame rich folk and let the incompetant prosecutor keep his job

Should Judge in "Affluenza" Case Be Removed?
There are growing calls for the judge’s removal in the controversial “affluenza” case.

Last week, a Texas judge sentenced 16-year-old Ethan Couch to 10 years of probation after he confessed to intoxication manslaughter in a crash that killed four pedestrians. Couch’s defense team argued that his reckless behavior stemmed from affluenza, a psychological condition that affects young people from wealthy families.

Some people are even calling for Gov. Rick Perry to take Judge Jean Boyd off the bench for the ruling.

Today on Your World, Judge Andrew Napolitano said the affluenza excuse is not viable in court. He said Judge Boyd should’ve rejected the psychologist’s assessment that Couch didn’t know right from wrong because of his privileged upbringing. “In Americans courts, before a scientific defense may be asserted, there must be a substantial acceptance of the defense in the scientific community.”

North Texas prosecutors are trying a second time to imprison a teen who was sentenced last week to 10 years' probation for drunkenly driving his truck into four pedestrians, killing them all.

Tarrant County District Attorney Joe Shannon has asked a juvenile judge to put 16-year-old Ethan Couch behind bars on two cases of intoxication assault that he says are still pending before the court, The Fort Worth Star-Telegram (http://bit.ly/JEXZpn ) reported Tuesday.

"During his recent trial, the 16-year-old admitted his guilt in four cases of intoxication manslaughter and two cases of intoxication assault," Shannon said in an email to the newspaper. "There has been no verdict formally entered in the two intoxication assault cases. Every case deserves a verdict."

If Couch violates the terms of his probation, he could be sent to prison for 10 years.

Under Texas juvenile law, the maximum allowable sentence in Couch's intoxication assault case would be three years in a Texas Juvenile Justice Department facility; he would be released no later than his 19th birthday.
