Arkansas Prank Went Wrong

CNN) -- A 15-year-old girl in Little Rock, Arkansas, is dead, police say, because of a prank that went horribly and tragically wrong.
Adrian Broadway was shot in the head and died early Saturday morning.
She was with a group of teenagers who had gone to a house to do a "retaliation" prank on another teen who'd done a prank on them on Halloween, according to the Little Rock Police Department.
The teenagers told police they had thrown toilet paper, eggs and mayonnaise on a car parked there.
As they were leaving, a man came out of the house and opened fire.
Broadway was struck in the head and died.
Another teenager, the driver, suffered injuries to his right arm. He was transported to a hospital, where he was treated and released.
Police have identified the shooting suspect as 48-year-old Willie Noble. He was charged with one count of first-degree murder, one count of a terroristic act and five counts of aggravated assault, they said.
Bond was set at $1 million.
"I got the news from my mom who said that Adrian had got a gun wound to the head, and I just dropped the phone immediately and started crying," Broadway's friend, Laguyia Bland, told CNN affiliate KARK.
"They was trying to be teenagers," Bland said. "As you know teenagers make mistakes, and this was one of those mistakes."

Arkansas state code 5-2-608 says deadly force may be used against another person if the“person reasonably believes the use of deadly physical force is necessary to prevent the commission of arson or burglary by a trespasser.” Burglary hardly sounds the same as someone “using deadly force against you”. In fact, burglary is defined in Arkansas law as:

5-39-201. Residential burglary
(a) (1) A person commits residential burglary if he or she enters or remains unlawfully in a residential occupiable structure of another person with the purpose of committing in the residential occupiable structure any offense punishable by imprisonment.

Unless they've changed the law in Arkansas since 2010, the shooter would seem to be in deep kimchi.

I don't know the specfics of that but be sure one day if you run a-foul on a protected class you'll get charged with murder, a hate crime, and a terrorist act. It's getting stupid.

If the car was in front of the garage, front door or on the street makes a bit of difference.

We'll if you would read this thread from the beginning I agreed with someone there was more to the story and gave that as a possible reason for the shooting. But please pick and choose to suit yourself.

I'd get cover and put a round at the ground to scare the shit out of them. If I discharged my weapon at all.

Yeah, it's pretty clearly vandalism.

Maybe the kids didn't think of it that way, but it is. And if somebody keys your car in the parking lot or decides to bust your window out and rummage through your stuff; those are most definitely issues your insurance company will handle for you.

I assume most of you all have homeowner's and/or auto insurance. Pay your deductible, file a police report and move on with your life. Or you could step out and start shooting and see where that gets you.

Point being, there is no justification for this shooting. The man who shot the gun was not in danger himself. Sure, his car was getting messed up and that sucks, but it's not worth taking someone else's life.
Some people think that their personal property deserves the same sort of protection and lethal force that they or their own families do.

Inside your house, threatening you and your family? Fire away.

Egging your car? Call the cops and file an insurance claim.

The laws vary by state. Texas give more leeway to shoot over property than Arkansas, for example.

Quote:
§ 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is
justified in using deadly force against another to protect land or
tangible, movable property:
(1) if he would be justified in using force against the
other under Section 9.41; and
(2) when and to the degree he reasonably believes the
deadly force is immediately necessary:
(A) to prevent the other's imminent commission of
arson, burglary, robbery, aggravated robbery, theft during the
nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing
immediately after committing burglary, robbery, aggravated
robbery, or theft during the nighttime from escaping with the
property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or
recovered by any other means; or
(B) the use of force other than deadly force to
protect or recover the land or property would expose the actor or
another to a substantial risk of death or serious bodily injury.

well, I probably would call the police if I lived in a neighborhood. I live out in the country, and my house sits about 200 yards off of a county highway. You can't see my house from the road at all. If someone is at my house, I'm fearing for my families safety, and while I probably come out with a gun and tell them to get, or fire a warning shot into the ground, I was simply saying that if I were frightened enough, I can see how this happens.

Not to mention, unless I could see that they were TPing the car, in which case, I'd just run them off, how do I know that they aren't thugs looking to steal my wallet from my car?

Look, I think it sucks. But, it is what it is. Don't go ****ing with other peoples shit. period.
