Should the Death Penalty be abolished?

Would love to hear arguments that it should in light of this update to the kidnapping murder in Springfield, MO:

SPRINGFIELD, Mo. -
A newly released document from the Missouri Department of Social Services says investigators suspect a girl from Springfield who was abducted and murdered last month was sexually abused. The disclosure about Hailey Owens, 10, had not been mentioned in court proceedings and documents in the case of her accused murderer, Craig Wood. If Hailey was sexually abused, however, prosecutors might be able to obtain a death penalty against Wood, if he's convicted.


A man kidnapped Hailey off a street in northwest Springfield about 4:45 p.m. on Feb. 18 as Hailey was walking home from a friend's house to her own home about two blocks away. Police found her body that night hidden in the basement of Wood's home in central Springfield. An autopsy found that she was shot in the back of the head.

Police arrested Wood outside his home less than four hours after the abduction. They then walked through the home but didn't find Hailey. They then got a search warrant and found her body in a tote box and wrapped in two garbage sacks.


The document showing that investigators suspect sexual abuse by Wood is one of two documents that the Department of Social Services released to reporters in response to state Sunshine Law requests. KY3's request was for "any documents of the Children's Division or other agencies of DSS relating to or mentioning Hailey Owens."


The two documents have many parts blacked out to protect Hailey's brother and people who talked to investigators about her and her family.


The document that was completed after Hailey's murder has several questions under the sexual acts/exploitation section. One is: "Do you suspect child has been sexually abused?" The person who filled out the form answered, "Yes." The document lists the place where the abuse took place as Wood's home, 1538 E. Stanford St. The name of the person who completed the document is blacked out.

The innocence project has led to the freeing of 312 wrongfully convicted people, including 18 who spent time on death row. . The burden of proof in capital punishment cases is "beyond reasonable doubt" and not "beyond a shadow of doubt."

Thus my stance is that I would rather have a truely guilty person not given capital punishment than have an innocent person falsely executed.

Finally, The death penalty is much more expensive than life without parole because the Constitution requires a long and complex judicial process for capital cases.

Fair points. In this case however, they know who did it and DNA evidence should be a breeze. There should be no problem identifying the monster with near certainty and a long trial probably won't ensue because of that.

I agree, but the poll asked if the death penalty should be kept or abolished. It didnt ask if the death penalty should be in that particular case. Thus, specifically answering the poll question (regardless of this case), as long as there is false positives, I cannot support the death penalty.

I *sigh* agree with Cosmo here.

In situation where a crime is grievous and proof is absolute, I'm totally behind it.

The problem is that often times people are convicted and sentenced to die because the crime is grievous and not because their guilt is obvious. As a society we love to see people punished and far too often we don't seem to care if it's the RIGHT person.

The death penalty has to go. I'm philosophically for it, but I can not trust the legal system to avoid executing an innocent person, especially since we pretty much know that Texas killed an innocent man (Cameron Todd Willingham) despite being shown very strong proof of his innocence.

I have zero tolerance for that, and do not believe that making a very rare mistake is an acceptable price to pay.

I guess the issue is really about irrefutable evidence with DNA proof. This particular case burned my blood but the new development has really infuriated me. I cannot believe people like this exist.

It's not only the trial, it's the multiples appeals, writs, etc. etc. etc.

And I would bet that you could say the same for most death penalty cases -- that whether or not the individual did it is not in question.

The thing is, you can't just have it for "clear cases." You either have it or you don't, and the fact that a particular case is clear does not cut down on the expense.

I guess I'm trying to think about what the defense could use to prolong any trial. Is there something in this particular case that's going to be in dispute? The guy is dead to rights. I suppose he can just go to prison and get absolutely thrashed in there by the wild animals awaiting his entrance.
