County In Virginia To Consider Regulating Group Assembly In Private Homes

Group Assembly in Residential Dwellings



Over the last several years, there have been complaints from residents regarding frequent and large gatherings at neighborhood homes. These gatherings can create parking, noise, and other concerns for the neighborhood. Although occasional, large gatherings - such as private parties, house concerts, religious meetings and social clubs - are expected and permissible activities at a home, gatherings that occur on a regular basis involving numerous people can detract from the residential nature of a neighborhood because most residential structures and neighborhoods are not designed to accommodate such events.

Accordingly, it is recommended that language be added to the Zoning Ordinance to define what is a permissible "group assembly," and when associated with a residence, when such a group assembly is an appropriate "accessory use." Currently, the Zoning Ordinance does not identify guidelines for the frequency or scale at which group assembly is considered to be a permitted accessory use to a dwelling. Without such specificity, managing and addressing impacts of these large, frequent gatherings becomes problematic, and the County is limited in its ability to respond to neighborhood concerns.

On February 18, 2014, Zoning Administration and Code Compliance staff presented the Board of Supervisors' Development Process Committee (Committee) with draft Zoning Ordinance text that limits the number of persons and frequency of large gatherings at a home. The Committee requested feedback from residents on the proposed text, and to that end, a series of open community dialogues are scheduled for this purpose as follows:
These community meetings will also address proposed revisions to the Noise Ordinance. The results of this community feedback for both issues will be discussed with the Committee at a future meeting.

A plan to ban “frequent and large gatherings at neighborhood homes” is a lawsuit waiting to happen, a Fairfax County supervisor predicts.
Officials will get an idea Wednesday when public-comment hearings begin in Virginia’s most populous county.

“I believe the county is risking a lawsuit and/or aconstitution challenge by interfering with peoples’ right to assemble,” Supervisor Pat Herrity said in a statement.

The proposed zoning ordinance limits “group assembly” at residences to 49 people a day. Such gatherings “shall not occur more frequently than three times in any 40-day period.

Yes we do. I have no idea how its determined if they do or don't but many, and probably most newer communities here in Johnson County have them. But the amount is not typically that much.

Ive never lived where an HOA was ever successful but that was years ago in my urban years. Always seemed like a bunch busybody types who seemed to know what was good for everyone else and had this need to impose their ideas.
Some HOAs are ridiculous but they wouldn't be needed if people weren't asses.

Only neighborhood issue I've had is when someone painted his house pink and his nearby neighbors raised a stink. He repainted.

Someone with way too much time.

I drive by a house a few blocks away that has no lawn. It is just weeds, dandelions and such. It might get mowed a couple times a year when it gets too high, but it is just weeds. No HOA. It would piss me off if I lived next door.

I'm not seeing a major conflagration here... there is a middle ground that can and should be found in this.

If you slam the available parking in your neighborhood twice a week, residents have a right to bitch and seek action... give here, take there... and everyone should be ok.
