Citing tourism, town bans open carrying of guns

LAKE OZARK A southwest Missouri community at the Lake of the Ozarks has banned the open carrying of firearms, even by people who have a conceal-and-carry permit, to avoid frightening off potential tourists.

The Lake Ozark Board of Aldermen voted 4-2 on Tuesday to approve the ban, which still allows permit-holders to carry concealed weapons. The measure was initiated by Police Chief Mark Maples in response to concerns of residents and business owners, the Lake Sun Leader reported.

Board members and some in the audience argued that the ban violates their Second Amendment rights. Supporters said it doesn't make sense to allow people to openly carry guns as the area also tries to cultivate its image as a tourist destination for families.

"We've had a tough time over the years promoting Lake Ozark as a family area," said Alderman Larry Buschjost, who voted for the ban. "We want you on the Strip with families, everywhere in Lake Ozark with families. We want you to bring your kids down here and let them loose. For the life of me, I don't understand why I would have to carry any type of gun, concealed or otherwise. "

Tourism or not, the city should not be treading on the Second Amendment for any reason, said Alderwoman Betsey Browning, who voted against the ordinance.

She suggested that businesses that don't feel safe allowing people to carry guns in their establishments either openly or concealed could post a notice saying no weapons are allowed on the property.

"There are bad people in the world, and by golly if I need a gun I'm going to have a firearm at my side or in my purse," Browning said. "I'm absolutely against this."

Audience member Gail Maeder was even more direct.

"Just because somebody felt scared is not a good enough reason to pass an ordinance that violates the Second Amendment," she said.

A Missouri law that's been in effect for more than 30 years allows cities to regulate the open carry and discharge of firearms, Lake Ozark City Attorney Roger Gibbons said.

But a bill passed in the state legislature this year could nullify the city's new ordinance if Gov. Jay Nixon signs it.

The Senate measure forbids municipalities from creating ordinances prohibiting the open carrying of firearms for anyone with a concealed carry permit. The bill also would eliminate any current municipal ordinance denying open carry to people with the proper permits.

Nixon has not said whether he will veto the measure.

But the KKK club house down on the strip, along Bagnal dam is just fine & scares no one, because you know it's disguised as a antique shop, till you get to the back of the store where all the KKK shit is for sale & right there in the open for anyone to see.

& as far as family environment along the strip or anywhere on the lake for that matter, is a joke. G/Qs titty bar is on the strip. & the lake is known worldwide for it's whores in every cove. Why the hell do you think I like going there to party. You wanna take the kids? Go to Branson

from my understanding, I believe SCOTUS said places could either ban open carry or conceal carry, not both. If a location bans open carry, than they cannot make an undue burden to concel carry.

I'm all for defending gun rights. But from what I've seen of most of these open carry jokers, they're just doing it for the intimidation shock factor. It's vital to put forth the idea that seeing a gun shouldn't automatically bring fear. That's what open carry should be about. But that's not what most of these people are doing.

I am not one of them, but they feel like getting people used to seeing guns and nothing bad happening is part of helping people understand that they don't have minds of their own and most owners are good people.

I'm all for allowing people to have guns, but I'm torn about open carry. I don't really think it helps anybody. It freaks out people who aren't used to guns, and all it will do is antagonize and threaten some people. I have no problem with conceal and carry, just not sure why open carry is needed. I saw a guy stroll into the gas station last night, 2am with his pistol tucked in the back of his jeans, exposed to the world. Aren't you supposed to not be able to take it into businesses or certain businesses?

I'm sure somebody who has a lifetime subscription to Guns & Ammo Magazine will come put me in my place in this thread.

I conceal and carry but never open carry, even though it is totally legal here in AZ. As far as I'm concerned, open carrying just makes me the first target if a psycho ****er is around.

It's different from state to state, but in most places it's legal by default. If a business doesn't want people carrying on the premises, they can post signs that say so, and then it's illegal to carry there.

Like you said, these people are jokers. I support gun rights as much as anyone else, but the open carry movement makes gun owners look like crazies. Plus, lets say that people get used to seeing people just walking around with an AR-15. Then one day a real crazy walks into a mall carrying an AR-15 ready to start blasting.

Thanks to the open carry movement, he gets all the way to the movie theatre before anyone decides something is amiss.

I don't carry open or concealed. When someone is visiting a state that allows guns to be carried and that disturbs them they should only visit states that require a criminal to open carry. They will feel safer that way I am certain~
