From the video it says he picked up a BB gun that was being sold by Wal Mart. He didn't bring anything into the store. They pointed out that it was laying on a shelf and had been unwrapped by a previous customer.

It's the equivalent of being accused of grand theft auto for taking a test drive on a car lot. Except this guy was executed for it.

I didn't sentence anyone to death. My issue is a guy calling in a complaint to the police wasn't at fault. He called the police.

There's a simple level of common sense involved here. Guy is waving the thing around erratically. The weapon looks real.

Should the police have used better judgement, maybe, but I can't say that judging by the video. For all I know they told him to get his ass down several times. I don't know.

this is my first time seeing this. Did this guy really pop off 4 shots and the "suspect" is still laying on the ground going "Why'd you shoot me?" This has to be the Matt Cassel of cops.

He was at fault for blatantly lying. I have no issue with him making the call.

I was the first person to post a pic of what the BB gun looked like, but don't you think there is a remote possibility that this incident would have ended differently if the caller would have said "there's a guy walking around with a gun and talking on his phone. He doesn't appear to be threatening anyone and really isn't paying attention to anyone else in the store."
