Neighborhood watch captain shoots innocent black youth and doesn't even get arrested

ORLANDO, Florida (Reuters) - The family of a 17-year-old African-American boy shot to death last month in his gated Florida community by a white Neighborhood Watch captain wants to see the captain arrested, the family's lawyer said on Wednesday.

Trayvon Martin was shot dead after he took a break from watching NBA All-Star game television coverage to walk 10 minutes to a convenience store to buy snacks including Skittles candy requested by his 13-year-old brother, Chad, the family's lawyer Ben Crump said.

"He was a good kid," Crump said in an interview, adding that the family would issue a call for the Watch captain's arrest at a news conference on Thursday. "On his way home, a Neighborhood Watch loose cannon shot and killed him."

Trayvon, who lived in Miami with his mother, had been visiting his father and stepmother in a gated townhome community called The Retreat at Twin Lakes in Sanford, 20 miles north of Orlando.

As Trayvon returned to the townhome, Sanford police received a 911 call reporting a suspicious person.

Although names are blacked out on the police report, Crump and media reports at the time of the shooting identified the caller as George Zimmerman who is listed in the community's newsletter as the Neighborhood Watch captain.

Without waiting for police to arrive, Crump said, Zimmerman confronted Trayvon, who was on the sidewalk near his home. By the time police got there, Trayvon was dead of a single gunshot to the chest.

"What do the police find in his pocket? Skittles," Crump said. "A can of Arizona ice tea in his jacket pocket and Skittles in his front pocket for his brother Chad."

Zimmerman could not be reached for comment on Wednesday evening at a phone number listed for him on the community's newsletter.

Crump said the family was concerned that police might decide to consider the shooting as self defense, and that police have ignored the family's request for a copy of the original 911 call, which they think will shed light on the incidents.

"If the 911 protocol across the country held to form here, they told him not to get involved. He disobeyed that order," said Ryan Julison, a spokesman for the family.

"He (Zimmerman) didn't have to get out of his car," said Crump, who has prepared a public records lawsuit to file on Thursday if the family doesn't get the 911 tape. "If he never gets out of his car, there is no reason for self-defense. Trayvon only has skittles. He has the gun."

Since Trayvon, a high school junior who wanted to be a pilot, was black and Zimmerman is white, Crump said race is "the 600 pound elephant in the room."

"Why is this kid suspicious in the first place? I think a stereotype must have been placed on the kid," Crump said.

Out of curiosity, let me ask two questions.

Question 1. If you're the parents, which sentence would you prefer?

A. Long murder sentence or death penalty or whatever - essentially remove the murderer from society.

B. Intermediate sentence for manslaughter or some lesser murder charge - call it five years - but with blood money payments to you for the rest of his life. (Assume something like $7,000 a year for discussion's sake, maybe 20% of his gross salary if he's joe sixpack murderer.)

C. Short sentence for manslaughter - call it 1 year - but with blood money payments to you for the rest of his life. (Assume something like $15,000 a year for discussion's sake, maybe 40% of his gross salary if he's joe sixpack murderer.)

Question 2. What sentence should society in general prefer from the ones above?


These cases always interest me. Is the guy dangerous? Obviously he is to 17 year-old black kids. Should he be in prison forever, or should he earn a living to at least pay something back to the family of the murdered child? It gets down to whether his motive was malice or stupidity.

Either way the kid is dead and what he did was inexcusable, so don't paint me as an apologist for the guy. I can see arguments going both ways, and if I was the parents I'd probably want to see the guy on death row.

The problems in this case for the prosecution / victim's family are fairly simple, yet the solution is incredibly complex.

Problem1 : No amount of punishment, allowed by THE LAW will ever be enough to satisfy the family, and the activists / Sharpton/ public / media etc...

Problem 2: The law would seemingly dictate that is is almost impossible that this would be Murder 1.

Problem 3: It would seem that the MAXIMUM Zimmerman could possibly be guilty of is Murder 2, and most likely negligent Homicide....

Problem 4: (See problem 1) In a case like this, murder 2 or negligent homicide (by an otherwise upstanding citizen) the sentence won't be enough to satisfy some, and it will be too harsh for some. No one will be happy, even if he does 8-10 years.

Problem 5: If it is Zimmerman crying for help in the audio tapes, and not Trayvon....the prosecution's case could go down the tubes. I believe based on the initial reaction by Trayvon's father that it was Zimmerman crying for help, but of course the FBI will analyze this...this will be one of the major, game changing points in the entire case. Everything hinges on this IMO. If Travon is crying for help, then it might mean Murder 2 is possible. If it is Zimmerman....all bets are off.


Solution: It would be difficult to accept as one of Trayvon's family members but it seems the most Zimmerman could possibly be guilty of is Murder 2...the very most. Depending on the difference between Murder 2 and Negligent Homicide, they may be able to force zimmerman into pleading guilty to negligent homicide, IF it is clearly Trayvon crying for help in the audio tapes. That is a large pill to swallow, but looking at it fairly unbiased, I don't see how a Jury would ever come to an appeal proof conviction of Murder 1 in this case...


Just my thoughts so far.

I would tend to agree, pawnmower, and I think you and I were typing similar thoughts at the same time.

My thinking is that the family is going to want to see this guy hung from the nearest tree, and I can't blame them at all. Being hanged from the nearest tree is not unreasonable. However, I don't think it's Murder 1. The guy thought he was doing something good, but because he was stupid he murdered an innocent person. There is no right answer beyond, "he needs to be punished for this".

How do you think the prosecution's case goes down the tubes if Zimmerman was yelling for help? If I'm the prosecution, I say, "Dude attacked a kid and the kid was defending himself. If Zimmerman is a wimp and started crying, that's his problem. It's not allowable to murder a kid who fights back when he's being attacked."

Just listened to the 911 call where (assuming) Treyvon is shouting for help and I am slightly upset. The fact that a person can be outside your home in broad daylight screaming for help and no one comes disturbs me on so many levels. Yes call the police, but for christs sake do something - maybe its just me - but we should have an innate instinct to try and help each other. I mean if you ( the general public) saw an able bodied man pummeling the ever living shit out of an 85 year old woman on your sidewalk or if this had been a girl would it change how you responded? Hide and call 911? Have we become so fearful of the legal system we refuse to get involved in anything? Someone tell me I'm wrong and explain to me why no one could stick their head out the door and say hey WTF are you doing?

That wasn't Trayvon calling for help, it was the homeowner.

Please do a little more research. Trayvon's father initially said that it couldnt be him....There are some who have said it is Zimmerman....This is the main reason (IMO) the FBI was called in.

Trayvon's father changed his story when Al Sharpton and the lawyers came into town. All of a sudden, he recognized his voice, supposedly, when he had been UNABLE to do so the 1st time listening to the tapes.

I'm not saying it is Zimmerman's voice for sure, but do not be 100% sure that it is Trayvon's. This is a HUGE, GIANT issue that will come up again....
