Obama’s 23 Planned Executive Actions On Guns

Here is a list provided by the White House of the 23 executive actions President Obama plans to take to reduce gun violence in the wake of the Newtown, Conn., massacre:

1. Issue a Presidential Memorandum to require federal agencies to make relevant data available to the federal background check system.
2. Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background check system.
3. Improve incentives for states to share information with the background check system.
4. Direct the Attorney General to review categories of individuals prohibited from having a gun to make sure dangerous people are not slipping through the cracks.
5. Propose rulemaking to give law enforcement the ability to run a full background check on an individual before returning a seized gun.
6. Publish a letter from ATF to federally licensed gun dealers providing guidance on how to run background checks for private sellers.
7. Launch a national safe and responsible gun ownership campaign.
8. Review safety standards for gun locks and gun safes (Consumer Product Safety Commission).
9. Issue a Presidential Memorandum to require federal law enforcement to trace guns recovered in criminal investigations.
10. Release a DOJ report analyzing information on lost and stolen guns and make it widely available to law enforcement.
11. Nominate an ATF director.
12. Provide law enforcement, first responders, and school officials with proper training for active shooter situations.
13. Maximize enforcement efforts to prevent gun violence and prosecute gun crime.
14. Issue a Presidential Memorandum directing the Centers for Disease Control to research the causes and prevention of gun violence.
15. Direct the Attorney General to issue a report on the availability and most effective use of new gun safety technologies and challenge the private sector to develop innovative technologies.
16. Clarify that the Affordable Care Act does not prohibit doctors asking their patients about guns in their homes.
17. Release a letter to health care providers clarifying that no federal law prohibits them from reporting threats of violence to law enforcement authorities.
18. Provide incentives for schools to hire school resource officers.
19. Develop model emergency response plans for schools, houses of worship and institutions of higher education.
20. Release a letter to state health officials clarifying the scope of mental health services that Medicaid plans must cover.
21. Finalize regulations clarifying essential health benefits and parity requirements within ACA exchanges.
22. Commit to finalizing mental health parity regulations.
23. Launch a national dialogue led by Secretaries Sebelius and Duncan on mental health.

What Are Obama's Gun Control Proposals? An Easy Guide

The sweeping gun-control package that President Obama unveiled Wednesday includes proposals to ban assault weapons, limit high-capacity magazines, and improve mental-health care. Many of the proposals will need congressional approval, but also included are several executive actions Obama plans to take. The proposals were developed by a task force led by Vice President Joe Biden in the aftermath of the mass shooting last month at Sandy Hook Elementary School in Newtown, Conn.

Here is a look at what Obama is proposing:

Assault Weapons Ban: Obama is seeking a reinstatement of an earlier federal ban, which expired in 2004. The original measure was signed by President Clinton in 1994, but Congress declined to renew it.

This didn’t accomplish shit last time but it looks sexy to ban scary looking weapons. Should this pass it should also apply to law enforcement agencies operating within the US and its territories.

Limiting High-Capacity Ammunition Magazines: Advocates of a limit on high-capacity magazines believe it could slow down a shooter planning to carry out a massacre, such as the one at Sandy Hook. Obama’s proposal would limit these magazines to 10 bullets. Rep. Ron Barber, who was wounded in the Tucson, Ariz., shootings, is one of the advocates for this proposal.

This is ****ed. My standard magazine for my Sig is 12 rounds. Nobody has explained to me for one second why making a shooter reload makes this measure worthwhile? First of all, mass shootings are such a statistical aberration that the efficacy of this measure is, at best, infinitesimal. Should it pass it would immediately make me, a law abiding citizen who completed his back ground check (at a gun show no less. So WTF there kids?) a criminal. That’s not justice and that’s not right. It is certainly an infringement upon my second amendment rights. Any attempt to “seize” my magazines through statist coercion is, once again, an infringement. I purchased my firearm and magazines legally, went through the back ground check, and have done absolutely nothing in violation of the law to justify making me a criminal. This. Is. Bullshit.

Should this pass it should also apply to law enforcement agencies operating within the US and its territories.

Getting Rid of Armor-Piercing Bullets: Although it is illegal to manufacture and import armor-piercing bullets in the U.S., the president is sending legislation to Congress that will ban the possession and transfer of the ammunition.

Can’t make them and can’t bring them into the country already? Then how is this even necessary? According to Libtard logic we have eliminated the threat. Why on earth would people have these in their possession within the US when it is illegal to manufacture them in the US and it is illegal to import them. They should be here in the first place let alone in people’s possession. Whatsoever is wrong with this picture? That’s right, this sums up succinctly and clearly why Libtard gun control logic is a ****ing failure.

Gun-Trafficking Law: A favorite of Mayors Against Illegal Guns, a gun-control group with major backing from New York Mayor Michael Bloomberg, this measure would help prevent the trafficking of guns between states. This measure would make it easier for law enforcement officers to go after “strawmen” who buys guns for other people and transfer them across state lines.

Title 18, United States Code, § 922 (a)(6) forbids gun buyers from making “any false or fictitious oral or written statement...likely to deceive with respect to any fact material to the lawfulness of the sale or other disposition of firearm or ammunition under the provisions of this chapter .” Among other things, dealers can’t deliver guns to felons, illegal aliens, juveniles, the adjudicated mentally ill and nonresidents (to keep local laws from being circumvented, persons are forbidden from buying guns outside their State of residence.)

You know what, go ahead and read 18 USC section 922 and tell me how much of O’s proposal isn’t already covered within that statute or can’t be carried out through mechanisms within that statute.

Universal Background Checks: Anyone who buys a gun at a store, a gun show, or through other private sellers would have to go through a criminal background check before purchasing the weapon, under this legislative proposal. Senior White House officials said there would be exceptions for transfers between family members, however. The president will also direct the Bureau of Alcohol, Tobacco, Firearms, and Explosives to explain to licensed dealers how to best run background checks on potential buyers.

I will only buy off on this if the US makes an adamant push to prioritize identifying mental cases and those on drugs as laid out in Title 18 USC Section 922 and putting those individuals into the national database. Moreover, those that do qualify under Title 18 as mentals should themselves be made to register so that law abiding citizens know where the danger in their communities may lie. Further, those citizens will be able to observe and report any activity related to firearms purchase and possession to the appropriate authorities.

Tougher Background-Check System: Through executive action, the administration will give states $20 million in new incentives to share their information with a broader background-check system. The president will address legal barriers to reporting information that the White House has deemed unnecessary. The president will also ask federal agencies to update their records and make them available to the national background-check database.

Again, identify the mentals first. Otherwise this is doomed to fail. He knows the population of Americans that commit gun crime so law enforcement and the administration should take immediate steps to prosecute those that own firearms in violation of current law and immediately get people fitting that criteria put into the national database that he wants to burden the rest of us schmucks to. Oh, and put together stricter sentencing guidelines for violent criminals and do away with reduced time and good behavior. Make use of a firearm in the commission of a crime punishable by death with a mandatory minimum of 20 years. First time recidivists of violent crime with a previous conviction based on violent crime shall receive a sentence of no less than 40 years and the crime will also be punishable by death.

Review of Prohibitions on Gun Ownership: The president will ask the attorney general to look into current laws that outline which people are prohibited from buying guns, and make appropriate recommendations to improve the system. Currently, felons and some persons with disabilities are not allowed to purchase weapons.


Nominate a New Head of the ATF: Obama will nominate Todd Jones as permanent head of the alcohol and firearms bureau. The agency has been without a congressionally confirmed director in six years. Jones is a U.S. attorney in Minnesota and has been serving as acting head of the ATF.

Gun-Violence Research: The president is seeking a resumption of research into gun violence by the Centers for Disease Control and Prevention through executive action. Congress halted the research because of lawmaker concerns that the agency was advocating for gun control. White House lawyers found that researching the cause of gun violence would not qualify as advocacy. The agency would be tasked with looking into the causes of gun violence, including a correlation between video games and violent behavior.

School Safety: The administration, through executive order, will allow local communities to use money under the “COPS” initiative — which is aimed at putting more police officers on the street — to hire “school resource officers” who could help improve safety in schools. The White House would also make more money available to cities and towns to allow them to hire more mental-health workers for schools. The administration will also work with schools to develop emergency plans that could help them become better equipped to respond to incidents such as a shooting.

The NRA missed the mark on their security guard program. There should be a national program based on the Air Marshall program which uses highly trained specialists to defend and be closer to schools in the event of an incident. Air Marshalls are, arguably, the most highly skilled handgun marksmen in the world and far more professional than any security for hire. Moreover, their goal is to blend into the environment and not stand out as a sore thumb making themselves a target. They can circulate within a district that puts them within an area where their response time would be quicker than law enforcement but their ability to fit in means that a prospective mental wouldn’t know for certain if the Marshall was within the immediate vicinity creating doubt, delay and confusion on the part of any prospective mental. This slows the mental down a damn sight better than limited capacity magazines.

Combating Bullying: Through the Health and Human Services Department, the administration will provide new resources aimed at reducing bullying.

This old canard. The US Gov’t has been aiming to reduce bullying for…oh…I don’t know 20 years. Give or take. Are they ever going to come up with something that actually reduces bullying?

Obamacare Regulations: The administration will develop regulations for the Affordable Care Act aimed at ensuring comprehensive care for mental-health problems. This would include putting money toward new social workers and psychologists.

Lower the bar on involuntary admission to mental institutions.

It probably won't pass, but the lack of effectiveness of the previous AWB was that it had 600 loopholes and didn't suggest any course of action for the AWs that were already bought and sold prior.

It's not right that someone who owns a guy with a 12 round magazine a criminal, I would agree. I'm willing to bet there's a provision either excusing it for folks like yourself, instigating some sort of buyback, or creating some sort of proven track record of proficiency/law-abidingness in order to allow access to a 12 round mag. I'm not sure yet, nobody really is.

The problem with guns isn't law abiding citizens. The FBI has a good bead on where the gun violence problems reside. If the issue were as simple as guns=violence then rural America would be awash in rivers of blood. As it is that is not the case so clearly gun ownership is not causal in this case. Gun violence is symptomatic of another problem. The FBI has a pretty clear bead on where gun violence occurs. How about we identify solutions in those areas most prone to gun violence and go from there? How about we identify the mentals out there and get them culled from the herd before they snap? How about we teach gun use, operation, and safety at the same time we teach sex education? The principle is the same; remove the mystery, educate the youth on proper use of the equipment because ****ing around with it can mess up a whole bunch of lives. Why are Americans and the left so abjectly terrified by firearms? The bacon in my fridge should be of much greater concern to my doctor than the firearms in my gun safe. But, no. This agenda is about doing away with something that is scary, that they don't understand, and that is part of the livelyhood of a section of American life that they don't particularly like or care about.

Also, it's Obama's ATF. Has been for 4 years. How he allocates resources to accomplish his agenda and meet the needs of his Presidency is on him. He hasn't seen fit to "fang" the ATF for four years that is on him. Not Congressional Republicans and certainly not on law abiding gun owners exercising their God given rights to life and liberty but their right to protect them.

Lastly, anything, and I mean ANYTHING applying to gun owners should be made to apply to law enforcement as well. No "assault weapons", no "high" capacity magazines, etc. If I don't need them to protect myself from an imminent threat they don't need them when they show up to clean up the mess that was me and mine.

Isn’t that very vague and very subjective? It just seems to me that if the situation arises and they just don’t want somebody to have a gun, they absolutely have a way to do it without any due process. You can be judged incompetent and they can just take your guns away without any recourse.
