I get his argument. However, festivals and events have city permits. Plus, the people who live in that area live in that area for a reason. They have the right to enjoy their dwelling. You can be a couple of blocks away and hear this guy. If it's something you don't want to hear, then that is disturbing. It's different if it was only customers, but the complaints come from citizens who live in the area. Without the amplification, he has no voice? You can still say what you want to say. If people want to stop and listen, they can. If they don't, it's nice to be able to walk a block or two away and not have to hear you. Knowing how conservative many in the justice system seem to be, I can totally see this guy winning.

We have a couple of guys with amplification equipment of Sundays preaching and reading the bible on a couple of semi-busy corners in a poorer neighborhood.

It's ****ing hot and they are out in a suit. No one is really paying attention. I thing they are nuts but I can respect their effort and passion. This is some old school free speech.

I think the OP is right on.

Every government has to deal with the delicate balance between religious expression and the broader interests of the population.

Constitutionally, you can only restrict this corner preacher's expression if you have a compelling reason to do so.

I think this is a fair judgment call, generally.

Judgment call, really. I think a reasonable argument can be made both ways.

You can restrict freedom of speech for any number of reasons:

1. if that speech creates danger (i.e. threats or yelling "fire" in a theatre)
2. supporting overthrow of the government
3. "obscenity"
4. any other compelling reason by the general population

Well, I know him doing that diminishes my enjoyment of downtown while he's there. Not because I feel guilty, but because he's annoying.

I get he may be annoying to some, but if he is playing by the rules as he said in the article then Springfield has a problem. Also the lack of a receipt for property is not the normal operating procedure for most police departments. I am basing this on what is said in the article, so who knows what really happened. I think the ACLU will have a field day with this case.

His freedom of expression has nothing to do with the artificially high volume at which he does it. He doesn't have a right to make sure he's heard two blocks away.

The govt can't restrict the message. Within reason, they can impose restrictions on time (example: shouting in the middle of the night), place (ex: middle of the street) and method (ex: amplification).

My understanding of the article is that there are restrictions in place and he has been following them. The cure is to make tougher/lower restrictions to decibels in public. Until then he has the argument that it is message related.
