Cop shot dog, owner blamed police

There are wrong in so many levels in this story.

If this dog is so aggressive that he lunged at an officer who came through the fence, there's no way that officer was going to be able to see a spud gun through a privacy fence without alerting the dog. It was revisionist garbage put forward by the cop and his enabling boss to cover his ass.

If I'm the neighbor and I'm scared... I want the officer to get to the root of the issue. For all the neighbor knew it was a real gun (I'm assuming as I don't know how p-guns sound). Whatever the case... what if someone was hostage or the p-gun was just the tip of the iceberg in the back.

Someone called because of shots fired in the backyard. Not inside the house or the front of the house. What if someone was back there laying dead... The guy should still go to the front of the house and knock on the door?

You're going to say, clearly nothing was happening. But all the officer saw through was cracks... He opened the gate to investigate further. He was probably wanting to knock on the BACK door which seems like the most logical thing to do.

Your illegal firearm thing is a good point. If I'm shooting in the back yard and police come to my back yard and see the (illegal) gun locked up in plain sight, they should have the right to PROTECT AND SERVE.

FURTHERMORE. I COULD OF AVOIDED IT ALL BY NOT SHOOTING MY GUN IN THE BACKYARD AND THEN TRY TO PLAY VICTIM WHEN THE POLICEMAN WAS JUST DOING HIS JOB.

Going to the back door, when it's surrounded by a 6-foot privacy fence, is not the most logical choice, to respond to the prior post.

And firing a potato gun does not somehow justify further poor judgment, in this case displayed by the officer.

I, too, want the police to do their jobs and respond to public concerns. But I'd prefer a little bit more common sense mixed into the equation on the part of the police.

Assuming that he's not a liar, the officer himself stated he saw a spud gun. Not a shotgun, not a Glock. No, the officer didn't think there was a dead body in the backyard. Quit trying to write in excuses for him. (and for the record, a spud gun sounds like a muffled black cat; they sound nothing like a firearm).

Taking him at his word, The officer saw a spud gun in the yard and nothing else. At best, he was essentially entering the backyard for an unannounced seizure of contraband.

So I ask again - if he was walking past your front door and saw a sawed off shotgun in the gun rack, I assume you'd be okay with him kicking your door in and taking it while you were away? That's what happened here - the rest of it is background noise. Who gives a rip what the neighbor was scared of, the cop had apprised himself of the situation (or more likely acted illegally, but we're ignoring that possibility for the moment). He knew what the situation was, knew there was nobody back there (unless you presume a deaf cop), and decided to simply enter the back yard when all he needed to do was knock. Hell, even calling over the fence would've alerted him to the dog and he'd have known to go to the front (getting back, again, to my - "the reckless idiot just walked into the fence and lied about it later" theory).

You are bending over backwards to create hypotheticals for this guy (maybe there were two completely silent asssassins in the back-yard hiding a dead body) while completely ignoring the facts as stipulated by the officer himself.

Sheriff Justice would be proud.

The cop probably should have knocked on the door at the address of a reported shooting, maybe stood with his back to the door after knocking, admiring the neighbor's flowers across the street.

I’ve used, I mean I’ve heard that if you use Ether instead of hair spray or WD-40 that it is a much stronger propellant and makes for a louder bang.
We used to, I mean I’ve heard that you can launch a potato through a metal trash can at 30 yards using Ether. It’s just a little scary watching that happen and knowing you just held that explosion in a PVC tube in your hands. Er, so I’ve heard.

Your entire post is an hypothetical. To sort of answer your question...
If I had the police called on me because I was in my backyard shooting and they saw a completely different gun... Yes, I deserve to get my things seized if they're in plain sight INSIDE MY HOUSE. Furthermore, in most cases, I deserve to get my home SEARCHED if I'm shooting firearms outside in public.

I gave them probable cause with my shooting stupidity.

Well congratulations, you've granted the local smokies more authority than the Constitution provides them. At least to this point, under our founding document, if the officer didn't directly observe the illegal conduct and doesn't have a search warrant, he's going to need your consent to that search.

Constitutional liberties can be pesky things for government officials. It sucks that they may have to take an extra step here and there to keep from destroying people's property.

You should probably send a few bucks to Barack, he could use your support.

Hell no, licensed or not.

I originally agreed that he handled this wrong.

But, what's the difference between knocking on the front or back door? The complaint said that the shooting came from the back yard. He went where the trouble was reported. If they were shooting out front, should he stand outside the fence and yell until someone came to the door?

Going through a yard gate is not the same as kicking in a door.

BTW...I also think the last quote was unprofessional.
