What neither side of the fence seems to realize is that no mater what, somebody loses.

A non-smoker is inconvenienced by either having to choose a smoke-free establishment, or inhaling and smelling like smoke, as well as a health hazard they didn't sign up for.

A smoker is inconvenienced by either having to choose an establishment that allows smoking, or being asked to step outside the building to smoke.

What amazes me is that OSHA hasn't stepped in an forced this a long time ago. There are thousands of regulations in the work place that wouldn't have been put in place if the "owner" got to make the decision.

History has shown that in most cases "owners" do not give a shit about the workers as long as the profits are good.

I am all for the STATE wide ban in Colorado - casinos were forced to join the ban as of 1/1.

Here is the 2nd most reeruned argument. Are you seriously suggesting that you didn't have options for non smoking establishments before said bans were in place? Don't be foolish, you want what you want, and **** anyone who it steps on. When it affects you, just .

Preferably a minimum of 20 feet from the door. For a while in KC you couldn't walk in or out of a building without going through a cloud of smoke.

Here's an idea. Let's pass a law making it illegal to take your kids to restaurants and movie theatres. It's annoying as hell, and business owners don't have the balls to disallow it.

I'm personally fine with the ban...mainly because I'm a total wuss when it comes to being around smoke. I won't go out to places that allow it. So basically an owner is either going to lose my business or maybe the business of a smoker. A smoker could, in theory, at least go outside and light up. I'm not going to walk out of a concert for 15 minutes to try to find fresh air...then go back into the cloud.

I understand the freedom of choice argument and I'm not 100% comfortable with legislating choice out of existence...but I'll be selfish in this case and say I'm OK with it.

I respect you being honest, however where does it stop? You like this right being taken away because you hate smoke. At what point is rights being taken away a problem?

Believe me, I'm conflicted about it. I totally understand what you're saying and I agree.

I don't have a problem with smokers being able to go outside and smoke...even though when I'm on a patio I can smell it and don't really like it. I figure we've got to compromise, and if I can get a non-smoking interior then I'm good with "sharing" patios, etc. IIRC in Indiana they just have really super-strict regulations about smoking and non-smoking areas inside the bars/restaurants...I think they actually have to have separate ventilation systems and the rooms have to be sealed off from one another. The smoking room is kept at a slightly lower air pressure so that smoke doesn't get out, etc. That always seemed like a decent deal to me.

Bottom line...smoking isn't good for you, and secondhand smoke turns non-smokers into smokers. The same is NOT true of alcohol. If I'm drinking and you're not, the alcohol in my drink isn't getting into your body. When you light up and I'm anywhere near you, I'm sucking in your fumes.

I don't care that it might kill me- I just hate the ****ing smell. 5 minutes in a smoky room and your clothes and hair stink. It's nasty.

I don't understand the "rights" argument very well, Mr. RedNeckRaider.

I mean, you still have the "right" to smoke your tail off at home, correct? How is it a "right" to gas your poor neighbors? You have the "right" to stick a croquet mallet up your ass, paint your pecker purple, and walk around naked in your own house, but society has the "right" to curtail that sort of activity in public, do they not?

This is where I see the difference. Smokers can't keep it to themselves. It's physically impossible.

If I really liked a certain kind of drink, but part of drinking it meant I was spitting it out all over the people at the tables around me how long do you think it would last before a smoker told me to cut it out?
