Arkansas Prank Went Wrong

CNN) -- A 15-year-old girl in Little Rock, Arkansas, is dead, police say, because of a prank that went horribly and tragically wrong.
Adrian Broadway was shot in the head and died early Saturday morning.
She was with a group of teenagers who had gone to a house to do a "retaliation" prank on another teen who'd done a prank on them on Halloween, according to the Little Rock Police Department.
The teenagers told police they had thrown toilet paper, eggs and mayonnaise on a car parked there.
As they were leaving, a man came out of the house and opened fire.
Broadway was struck in the head and died.
Another teenager, the driver, suffered injuries to his right arm. He was transported to a hospital, where he was treated and released.
Police have identified the shooting suspect as 48-year-old Willie Noble. He was charged with one count of first-degree murder, one count of a terroristic act and five counts of aggravated assault, they said.
Bond was set at $1 million.
"I got the news from my mom who said that Adrian had got a gun wound to the head, and I just dropped the phone immediately and started crying," Broadway's friend, Laguyia Bland, told CNN affiliate KARK.
"They was trying to be teenagers," Bland said. "As you know teenagers make mistakes, and this was one of those mistakes."

Sec. 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property:
(1) if he would be justified in using force against the other under Section 9.41; and
(2) when and to the degree he reasonably believes the deadly force is immediately necessary:
(A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or recovered by any other means; or
(B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.

I'm going off the assumption that the guy who shot the kids had no idea what the kids were doing, that is, all he heard were loud/disturbing noises? However, if the guy shot the kids because of the egging and mayo then yes, this guy deserves to get judged by the law because it's obvious, he over-reacted!

He actually fired at the car as they were fleeing, so I'm guessing by that time he knew what they had done. Hard to say for sure though. And no question he over-reacted. I'm not justifying what he did, I am simply taking exception to this crazy notion that calling the cops would do anything to help the guy in this situation. They're not going to launch a full scale investigation over a property damage incident.

He acted recklessly and should be punished to some level, I don't have enough details to know what level. Prison, probation, I have no idea. I don't see how it as a case of self defense.

I am 100% pro-gun and its stories like this that cause me concern considering it seems every other person in the country is getting a C&C permit anymore.

I'd laugh my ass off if this was your daughter and he got probation.
