Patriots' Hernandez Questioned By Police in Homicide Probe

NORTH ATTLEBORO, Mass. -- New England Patriots tight end Aaron Hernandez was questioned by police investigating a possible homicide in this town 40 miles south of Boston. A source with knowledge of the investigation said Massachusetts State police spoke to Hernandez on Monday and were interested in possibly searching his home.

Hernandez is not believed to be a murder suspect, according to a source, but a vehicle rented in his name has emerged as a key piece of evidence in the investigation. The Sun Chronicle of Attleboro, Mass., reported on Tuesday that police identified a rented 2013 Chevrolet Suburban with Rhode Island license plates in connection with the possible homicide. According to the paper, the vehicle is registered to Enterprise and investigators were hoping to analyze it for fingerprints. A source said Hernandez's name is tied to that rental vehicle.

A jogger found the body of a 27-year-old Boston man on Monday in an North Attleboro clearing, less than a mile from Hernandez's home.

A North Attleboro police car idled in front of Hernandez's home on Tuesday, parked across the street from two television news vans. Yasmina Serdarevic, a spokesperson for the Bristol County District Attorney's Office, declined comment on Tuesday afternoon when contacted by SI.com.

A source close to Hernandez confirmed that the player had spoken with authorities in connection with case, but would not elaborate. Athletes First, Hernandez's agency, declined comment when contacted by SI.com. Hernandez has consulted with a lawyer, who did not return a call from SI.com.

A fourth-round pick in the 2010 draft, Hernandez was named to the Pro Bowl in his second season. Last season he caught 51 passes and scored five touchdowns for the Patriots.

All that means is that the glock he bought in college came with two standard capacity magazines(I'm assuming 9mm so 17 rounds). He kept them but in mass it is illegal to possess magazines that aren't restricted capacity(i.e. <= 10 rounds).

Those two 'crimes' he'll never serve time on. I'm also willing to bet that one of the 'crimes' he'll be charged with is failing to have a Firearms ID card and another one will be failing to register said firearm with the state police.

So we've no determined the murder charge and at least 4 silly charges he's likely to face(but likely no real time for any of those four charges not with his lawyers).

The only real charge it looks like he has to face is the murder charge. If he serves any time for any of the firearms 'charges' it will be as a result of a plea deal to kill the murder charge.

Boston Globe: Hernandez charged with murder

ATTLEBORO — Former New England Patriots player Aaron Hernandez executed his acquaintance Odin L. Lloyd because Hernandez was upset that Lloyd had spoken at a Boston nightclub on June 14 with people Hernandez “had troubles with,” a prosecutor alleged today.

In a dramatic hearing in Attleboro District Court, the prosecutor said surveillance videos in Boston, in North Attleborough, and even in Hernandez’s own home linked him to the slaying several days later of Lloyd.

Lloyd was shot five times in a North Attleborough industrial park not far from Hernandez’s home. He raised his arm as he lay on the ground, in a desperate attempt to fend off the bullets, Bristol County prosecutor William McCauley said.

The prosecutor said Hernandez, who was accompanied by two men, had the means, motive, and opportunity to kill Lloyd and had been the prime mover in the crime. “He orchestrated his execution,’’ McCauley said. The prosecutor said Hernandez had spoken of no longer trusting Lloyd.

The identity of Hernandez’s two confederates was not disclosed at Hernandez’s arraignment.

Hernandez’s arraignment came after a week of suspense in which media had camped out in front of Hernandez’s home and followed his car by helicopter, in a futile search for details from tight-lipped law enforcement officials. Residents in Massachusetts and beyond have been riveted by the story of a highly paid professional athlete who may have squandered a bright future.

McCauley said Hernandez summoned his two friends, then drove to Fayston Street in Boston’s Dorchester section early on the morning of Monday, June 17, where Lloyd, a 27-year-old semipro football player, left his home, got in the car, and then rode south to North Attleborough.

Along the way, Lloyd alerted relatives in a text message, asking them, “Did you see who I am with?” After they asked who, he replied cryptically, “NFL,” the prosecutor said.

“Just so you know,’’ Lloyd added. It was the last text message he sent before he died, McCauley said.

Surveillance cameras in the North Attleborough industrial park where Lloyd was murdered captured the men arriving in the same silver Nissan that Lloyd had gotten into in Dorchester, the prosecutor said.

Once near a wooded area, Lloyd started climbing out of the car, and was shot once, which knocked him to the ground. As he lay there, he raised his arm and was shot multiple times. Five spent .45-caliber spent shell casings were later recovered, McCauley said.

When Hernandez returned home around 3:30 a.m. Monday, surveillance video at his house showed him walking through his house holding a pistol in his hand, the prosecutor said.

Not-guilty pleas were entered on his behalf. Judge Daniel J. O’Shea ordered Hernandez held without bail.

Hernandez attorney Michael Fee, arguing for bail, said the prosecution case was “circumstantial ... not strong.”

Hernandez also faces five illegal firearms charges.

The courtroom where Hernandez appeared was filled with people, including Lloyd’s mother and other relatives; Hernandez’s fiancee; and a large contingent of reporters. When prosecutors described Hernandez returning home with a gun in his hand, Lloyd’s mother, sobbing, had to leave the courtroom. Hernandez’s fiancee also left the courtroom in tears.

Hernandez, a Bristol, Conn., native, showed no obvious emotion as he stood, his hands cuffed in front of him. Defense attorney Fee and prominent defender James L. Sultan, who is also on the defense team, stood nearby.

After the arraignment, Fee spoke briefly with reporters, saying that he wants the issue of his client’s innocence resolved in the courtroom not in the media.

New England Patriots Aaron Hernandez Charged With First-Degree Murder

Aaron Hernandez went to bed last night a member of the New England Patriots and a free man. However, this morning he was cut by the Patriots and by this afternoon, he was charged with the first-degree murder of semi-professional football player Odin Lloyd.

This afternoon, the prosecution brought forth their allegations against Aaron Hernandez in the murder of Odin Lloyd. The district attorney alleges Hernandez is guilty of first-degree murder and the unlawful possession of five separate firearms.

Hernandez showed no emotion toward the prosecution’s allegations even though; the story was detailed to the minute consisting of both direct and circumstantial evidence. The evidence consisted of the unlawful possession of multiple firearms, camera footage, third party affidavits and text messages sent from Hernandez that ultimately led to Judge Daniel O’Shea denying Hernandez bail. Even though Massachusetts has a statutory preference for an alleged bail, a defendant alleged with committing first-degree murder shifts the presumption for bail back into the discretion of Judge O’Shea’s upon considering all of the alleged facts.

First-degree murder in Massachusetts (M.G.L.A 265 §1) is defined as:

Murder committed with deliberately premeditated malice aforethought, or with extreme atrocity or cruelty, or in the commission or attempted commission of a crime punishable with death or imprisonment for life, is murder in the first degree. Murder, which does not appear to be in the first degree, is murder in the second degree… The degree of murder shall be found by the jury.

The prosecution has the burden to prove, beyond a reasonable doubt, that Hernandez with the requisite level of intent or in legal terms malice afterthought, committed the heinous murder of Odin Lloyd. If the jury finds Hernandez guilty of murder in the first degree, Hernandez will be sentenced to life in prison. Massachusetts lacks a death penalty statute.

However if the jury does not find Hernandez guilty of first-degree murder, they may still find him guilty of murder in the second degree. Carrying a much lighter penalty, one convicted of second-degree murder shall be sentenced to life in prison with a chance of parole after fifteen years.

Despite being overlooked by the shadow of a first-degree murder charge, Hernandez was also charged with the unlawful possession of five separate firearms.

Whoever knowingly has in his possession a firearm, loaded or unloaded without…having in effect an issued license to carry firearms…shall be punished by imprisonment in the state prison for not less than two and one-half years nor more than five years, or for not less than 18 months nor more than two and one-half years in a jail or house of correction.

Even if the jury finds Hernandez not guilty of first or second-degree murder, he may still face between two and a half and five years in prison for the unlawful possession of a firearm. The prosecution alleged that Hernandez’s firearm identification card is expired.

Allegedly, it all went wrong on Friday evening. Lloyd and Hernandez apparently went out together to Rumor’s nightclub, where Hernandez saw Lloyd speaking to individuals that Hernandez did not see eye to eye with. This, in the district attorney’s eyes created a level of disloyalty and a lack of trust, which led to Hernandez’s motive behind the alleged first-degree murder. Hours before the homicide, Hernandez stated in a security video to an unknown third party stating “You can’t trust anyone” and sought the third party’s presence in Boston, immediately. The prosecution alleged that at this time there is video footage from Hernandez’s house that has him holding a firearm. Upon arrival, Hernandez and the unknown third parties drove to Lloyd to pick him up. Hernandez drove the silver rental car to the location where the body was found and allegedly took steps to orchestrate the murder of Odin Lloyd. Subsequently, Hernandez and the unknown accomplices drove to Hernandez’s home, which is caught on Hernandez’s home surveillance footage, where the parties took steps to conceal and destroy all relevant evidence from that evening.

As stated earlier, the New England Patriots cut Aaron Hernandez from their roster before charges came down. The move prevents the team from recovering any of the $12.5 million dollar signing bonus from his 2012 contract extension signed last summer, which was worth a total of $39 million dollars. However, the millions of dollars Hernandez gained from the Patriots may ultimately be turned over to Hernandez’s legal counsel. In 2000, Ray Lewis spent millions of dollars in legal fees in order to acquit himself of murder charges. What remains to be seen is whether Hernandez is due $3.25 million dollars from the contract extension on March 31, 2014, or if the Patriots have cause now that Hernandez has been charged with murder to avoid paying this sum.

Despite the facts and inferences pointing towards Aaron Hernandez being guilty of first degree murder, it is important to understand that the court will view Hernandez as cloaked in a presumption of innocence until proven otherwise.
