Can you tell if the guy I sold my xbox to has been using my account? Does it have a last log in date? If its before April 5th or so then he hasnt. I'm just afraid the guy has been using my account if I had it set to auto login.

What if I'm trying to get on when hes currently using it? Will that disable me from logging in?

I can tell you that from my friends list, is shows you as "Offline" with no last time online - which tells me that he hasn't used it in at least 3 months. So you should be good to just recover it without any problems.
