Perhaps. You seem like a very bright guy. I just don't see why the passenger has any right to feel like a victim when they trusted their life to a drunk driver. I feel like they should issue tickets for everyone over the legal limit in the car if the driver is also over the limit. The entire car should get a DUI

And this is coming from a guy who thinks the DUI penalties are far too harsh. There should be ticketed DUIs that don't ruin your life...I realize that's a slippery slope but, I don't know. Some people are fully functional and more than capable at .13 and some people are embarrassingly fall down drunk at .08

I imagine the penalties differ by locality but I think they are far, far too lenient in many cases. There are people with 4 and 5 DUI's getting nothing more than a week in jail and a fine.

This is absolutely true IMO. My buddy and I had a cop give us a "courtesy" breath test coming out of a bar one night. He drank far more often than I did, but because I outweighed him by 100lbs he was at .072 and I was at .045 and the cop said I should be the driver even though I was CLEARLY more intoxicated than he.

The reason behind different alcohol concentration is how the body of person reacts to it as it might differ with each person. When I worked with a Los Angeles DUI attorney, I saw so many similar cases that people who blew around .09 got away on the pretext of wrong reading as their behavior was quite normal.
