The nice thing is that the list he previously put forward is essentially the list he's using now so there's a lot of information on those folks out already.

Gorsuch was my favorite last time and I got what I wanted (and the whole reason I voted for Trump to begin with). If he can get Barrett on there as well, I won't just hold my nose and vote for the man in 2020, I'll vote for him as a reward for a job well done.

  • Flake's a definite wild card in this. His bitch-like behavior could have him pulling the same sort of shit on the judge nominee that McCain pulled with the Obamacare repeal.

I'd eat my hat if Roberts overturned Roe.

And for that matter, there are no assurances that Alito or even Gorsuch would. Thomas would, we know that. We think Gorsuch and Alito would but there isn't a clear track record for either of them that I've ever seen (doesn't mean it's not there, but I don't recall either of them ever clearly articulating a position regarding how they'd rule at the SCOTUS level).

But Roberts? Don't see it happening.

Here's the interesting part, though - let's Alito and Gorsuch are pro-life and willing to overturn Roe. And let's say the new Justice is as well. With Kennedy not wanting this fight and Roberts probably not wanting to go on record, Alito, Gorsuch and Thomas couldn't force cert.

But Alito, Thomas, Gorsuch and New Judge can get it to 4 and grant cert to one of these cases. They'd force Roberts to go on record in another of those legacy kind of defining cases. Frankly, I still think he'll leave the right intact, but I don't imagine he's too eager to see someone appointed that's itching for this fight either. Guy's name will end up going down like Souter's in conservative circles.

Manchin is damn interesting, isn't he?

The guy may be the final decider when it gets right down to it. And full disclosure, before Scalia died, Manchin was my "if they'd put forward someone like X, i'd vote democrat before Trump..."

Scalia scrambled the calculus and made the decision easy for me. But I have a lot of respect for Manchin and think he may actually do something sane here if it comes down to it.

I also forgot about Murkowski and Collins. Barrett might be able to get past them but if you try to put Willett up there, I don't see a chance in hell you'd get their vote.

With Flake being Flake and McCain being incapacitated, you can't lose the both of them.
