Personally I'm a huge fan of Willett but good luck trying to get another Scalia on the bench to replace Kennedy. You can try to argue that Roberts effectively replaces Kennedy as the swing vote and that Willett is just putting a reliable conservative on the bench, but you probably won't get much traction.

The whole thing will be fascinating. I would love to see a female constructionist with no real abortion track record to speak of get the gig as I'm not someone who's interested in re-litigating abortion for the rest of my life and I'm a little tired of the optics of Republicans just putting white dudes on the bench (though Bush tried with Miers and thankfully that didn't go through).

People really need to read up more on Roberts. The guy's gonna be Rehnquist. When Rehnquist was an associate justice he was far more conservative than Roberts is now, IMO. But when he took over as Chief (Berger?), he moved very much into the moderate camp. He was still more conservative than he wasn't, but he moved to the center in a big, big way.

Look at the relationship he formed with Ginsburg and you will see the template for what Roberts and Kagan will almost certainly be in the years to come. Those are two ideologically opposed but extremely well qualified, serious justices who will lead their respective blocs. And in the end this court will be almost a carbon copy to the Rehnquist Court that trended conservative but hardly sent the country into a dark age.

Besides, if Obama got to put Sotomayor on the bench, Trump could put the local dog catcher on and I wouldn't be too heartbroken over it. Obama got his unqualified lapdog so hey, might as well give Trump one as well.
Kagan was really a great choice by Obama. I don't agree with her politics, but I don't really feel she is a demagogue. He made up for that though with Sotomayor who has absolutely no business being a SCJ. None. Not impartial in the slightest.

I'm not sure McCaskill's decision will make a difference regarding her re-election chances, do you?

Don't get me wrong - I have no idea what direction her seat will go, but I don't think there's enough of a groundswell on the SCOTUS vote in Missouri to swing it either way. I hadn't really considered ND to be in play but I could be wrong, especially after the 'high 5'. I can't claim to have any finger on the pulse of the ND electorate when it comes to abortion rights.

That's going to be the narrative that emerges from this entire process. That's why I hope beyond hope he puts a female up there so it doesn't devolve into 'another conservative male attacking women's reproductive rights' argument going into November.

It's shallow thinking to be sure, but there are some damn qualified female candidates and I have no problem putting one of them on here to avoid that particular dogfight for the time being.

I have the utmost respect for Kagan and even when I disagree vehemently with her, I usually appreciate where she's coming from. That said, her Janus dissent was that particularly heinous form of consequential logic that runs rampant among the liberal wing and I hate it; "I don't like what will come of this so I'll ignore the legality of the thing..." Textbook activism there and beneath her, IMO.

As a matter of course, she has a view on the law that takes her in a liberal direction in terms of outcomes and I disagree with her interpretation but ultimately respect her process (like RBG before her). Sotomayor, OTOH, has a view on politics and will just make up law to suit it. And when she took a shot across Kagan's bow a couple of weeks ago for 'legal and factual errors', I hope Kagan set a flaming bag of shit on her desk.

I absolutely concede that there's nothing approaching a legitimate sample size, but we don't have a single women SC justice who hasn't been at least wobbly, if not outright leftist, in regards to their willingness to disregard the Constitution on social and women's issues. So, no woman on this pick, if you please. Hell, no choice of anyone who even gives off the faintest odor of possible wobbliness. If Trump gets a 3rd pick and he wants to gamble on replacing Ginsberg or Breyer with a woman he thinks won't be a mistake, maybe I can be convinced at that point, depending upon how the first two choices appear to be working out at that point.

Let the left rail. Not giving a shit has been Trump's greatest strength, so far. He should keep that going.
