Report: White House aides used GOP e-mail to skirt law...err, SWAMP!

WASHINGTON (CNN) -- E-mail records are missing for 51 of the 88 White House aides with Republican Party accounts, the House Oversight and Government Reform Committee reported Monday.

The White House says the accounts were set up to keep political work separate from official business, but investigators concluded White House officials used the accounts to conduct official business in a way that circumvented the Watergate-era Presidential Records Act.

The 37 accounts the Republican National Committee did save include nearly 675,000 individual messages -- more than 140,000 of them from Karl Rove, President Bush's top political adviser.

"Whether intentionally or inadvertently, it appears that the RNC has destroyed a large volume of the e-mails of White House officials who used RNC e-mail accounts," the report states.

The committee found 88 officials who held GOP e-mail accounts; the White House had acknowledged 50.

In a deposition given to committee aides, former Rove deputy Susan Ralston listed a series of White House officials who used party accounts daily. But the RNC "has not retained a single e-mail to or from any of these officials," the report states.

Ralston testified that Ken Mehlman, former director of political affairs, used his account daily, but the RNC has no e-mail records for him.

Additionally, "there are major gaps in the e-mail records of the 37 White House officials for whom the RNC did preserve e-mails," the report states.

The committee, led by California Democrat Henry Waxman, began looking into the GOP e-mail accounts after messages from the accounts turned up in two cases -- the case of imprisoned lobbyist Jack Abramoff and the 2006 firings of eight U.S. attorneys by the Justice Department.

The committee found that although then-White House counsel Alberto Gonzales ordered presidential staff to preserve official e-mails from outside accounts, he failed to enforce that policy.

Ralston told investigators that Gonzales, now attorney general, knew Rove was using his party e-mail account for official business, "but took no action to preserve Mr. Rove's official communications," the report states......

I am not sure if you are actually referencing something that happened. I didn't follow politics closely then. I was playing Golden Eye and so were you probably. If the lowest common denominator mis good enough for you so be it. It is 2007.

I thought you were referencing the U.S. attorneys that were fired. Everyone got up in arms over the handful that were fired recently, but I was referencing that Clinton fired all 93 of them on the same day and then said that "these people are routinely replaced" when in fact it was unprecedented.

They are routinely fired during a change of administration, not in the middle of a sitting president's second term, for what was initially called performance reasons, and then subsequently denied to be performance related by the same person, Tony Snow.

Leahy: Missing White House Emails Found, But Still Witheld From Congress

In April, the White House claimed that “it had mishandled Republican Party-sponsored e-mail accounts used by nearly two dozen presidential aides, resulting in the loss of an undetermined number of e-mails concerning official White House business.” They also acknowledged that some of the “missing” emails may be related to the U.S. attorney scandal.

In an impassioned speech, Sen. Patrick Leahy (D-VT) said at the time that the White House was lying and the emails could be recovered:
“They say they have not been preserved. I don’t believe that!” Leahy shouted from the Senate floor. “You can’t erase e-mails, not today. They’ve gone through too many servers. Those e-mails are there, they just don’t want to produce them. We’ll subpoena them if necessary.”

“Like the famous 18-minute gap in the Nixon White House tapes, it appears likely that key documentation has been erased or misplaced. This sounds like the Administration’s version of ‘the dog ate my homework.’”
Today, during a Senate Judiciary Committee meeting, Leahy revealed that the White House does indeed have the emails, but has yet to turn them over to Congress:
The White House stonewalling the congressional investigative committees continues this pattern of confrontation over cooperation. We all remember when they first announced to us that significant e- mails that we wanted had been destroyed. They’d been lost. I stated on the floor of the Senate that it’s relatively easy to find those lost e-mails. This brought another blast from the White House, saying that I obviously had no understanding of how the Internet works and of course that couldn’t be done.

To their credit, the White House has now told me they — well, yes indeed, I was right; they were wrong. The e-mails are found. They were there in a backup system, although they have yet to give them.
Now that their claim of “lost” emails has been proven false, the White House must turn them over to Congress. Claims of executive privilege are not sufficient to deny these emails to congressional investigators as the use of “Republican Party-sponsored” email addresses significantly undermines any claims to such privilege.
