Well, Monday morning, 5-7 new jobs may be cut or delayed.

We were planning to hire 5-7 new developers in April for a big job in May. However, I have no clue what this bill will have on our immediate/future bottom line.

Questions that I will be asking the lawyer and accountant:

Question: When do we have to provide insurance for everyone? (right now they get a cash amount towards their insurance...for single people, its enough; for associates with families, they pay the difference.)

Question: What happens if we lay off everyone and rehire as 1099's? Am I still obligated for their insurance?

Question: Would we be better off sending the projects overseas rather than doing in USA? I refuse to do this, but if taxes/insurance goes up, I may have no choice.

I have a feeling millions of C-level and business owners will be asking these questions and more. In the mean time, hiring will be impacted or stop.

You cant be serious. Talk about a knee jerk reaction.

If you were really going to hire these people tomorrow, hire them.

If you were just throwing this out there to generate some drama, nice try.

NOW, read the post nice and slow. We have been planning to hire these folk for several months. Would I be better off to hire them as 1099's or other options? I want to know my options. Do you know what they are; or you just shooting off?

Is that so hard to understand? Would you like me to use smaller words and type slow?

I dont know what the options are yet but I do know that it will be years before it will effect you. I know that putting off hiring someone tomorrow is a knee jerk reaction to a bill that we all dont seem to like. I am expanding my business right now and I wont let this stop me from going forward. Neither should you.

Maybe this is new to you, but businesses take into account their future plans as they hire someone. And you don't know if it will be years. Which is why he holds off on hiring until he sees what is going on.

You had better be VERY careful with that. Clear this with your lawyer, then think about getting a second opinion before you start treating everyone as an independent contractor.

This used to be the popular thing to do and enforcement was a bit loose, but now this is one of the big things that the IRS is cracking down on mega-hard.

There are a lot of tests that have to be met before you can 1099 someone. For example, if they have to show up at a specific time or place, and if they have to follow directions from you on the fine details of what you want (ie your basically their "boss"), then they are an employee, not a contractor. There's a lot of other tests too aside from that.

I hope you are right. It makes sense that impact should be a ways out. But I will ask just to make sure. How expensive is this going to get?

Unless you are a one man band, you are responsible for these people. So you need to check for yourself.

Under the new law, businesses that hire anyone unemployed for at least 60 days would be exempt from paying the 6.2 percent Social Security payroll tax through December. Employers also would get an additional $1,000 credit if new workers remain on the job a full year. Taxpayers will have to reimburse Social Security for the lost revenue.


I guess you're going to pass on that, then?

Maybe this is news to you. He stated they have a big project that they have been planning on hiring 5-7 people for months. That means this big project is dependent on hiring these 5-7 people. This health care bill is in its infant stages and to let it derail a big project at this point is not good business.

I understand wanting to know the options, we all do. My problem is letting it stall your plans for the immediate future.
