Neighborhood watch captain shoots innocent black youth and doesn't even get arrested

ORLANDO, Florida (Reuters) - The family of a 17-year-old African-American boy shot to death last month in his gated Florida community by a white Neighborhood Watch captain wants to see the captain arrested, the family's lawyer said on Wednesday.

Trayvon Martin was shot dead after he took a break from watching NBA All-Star game television coverage to walk 10 minutes to a convenience store to buy snacks including Skittles candy requested by his 13-year-old brother, Chad, the family's lawyer Ben Crump said.

"He was a good kid," Crump said in an interview, adding that the family would issue a call for the Watch captain's arrest at a news conference on Thursday. "On his way home, a Neighborhood Watch loose cannon shot and killed him."

Trayvon, who lived in Miami with his mother, had been visiting his father and stepmother in a gated townhome community called The Retreat at Twin Lakes in Sanford, 20 miles north of Orlando.

As Trayvon returned to the townhome, Sanford police received a 911 call reporting a suspicious person.

Although names are blacked out on the police report, Crump and media reports at the time of the shooting identified the caller as George Zimmerman who is listed in the community's newsletter as the Neighborhood Watch captain.

Without waiting for police to arrive, Crump said, Zimmerman confronted Trayvon, who was on the sidewalk near his home. By the time police got there, Trayvon was dead of a single gunshot to the chest.

"What do the police find in his pocket? Skittles," Crump said. "A can of Arizona ice tea in his jacket pocket and Skittles in his front pocket for his brother Chad."

Zimmerman could not be reached for comment on Wednesday evening at a phone number listed for him on the community's newsletter.

Crump said the family was concerned that police might decide to consider the shooting as self defense, and that police have ignored the family's request for a copy of the original 911 call, which they think will shed light on the incidents.

"If the 911 protocol across the country held to form here, they told him not to get involved. He disobeyed that order," said Ryan Julison, a spokesman for the family.

"He (Zimmerman) didn't have to get out of his car," said Crump, who has prepared a public records lawsuit to file on Thursday if the family doesn't get the 911 tape. "If he never gets out of his car, there is no reason for self-defense. Trayvon only has skittles. He has the gun."

Since Trayvon, a high school junior who wanted to be a pilot, was black and Zimmerman is white, Crump said race is "the 600 pound elephant in the room."

"Why is this kid suspicious in the first place? I think a stereotype must have been placed on the kid," Crump said.

He was given explicit instructions as a part of his duty that he is never to pursue a suspicious person and was specifically told it was to avoid confrontations like this. His job was to be the eyes and the ears of the police.

You can't treat him like an ordinary citizen. This is a guy who got out of his car specifically to pursue a guy he thought was suspicious against the explicit instructions of his training.

The law doesn't care what job you are doing or what you have been told. The law is the law. The law isn't written around a specific person or job. So it doesn't matter how you want to treat him. The law states xyz. If he falls into xyz then he is guilty, if he doesn't then he is innocent. Pretty simple. That may open him up more to a civil suit but not to criminal charges.

Now you're starting to make a distinction. I agree that it's going to be difficult to find him guilty of murder. I thought you were implying that Zimmerman had every right to get out of his car. Procedurally, he did not. A cop has a greater degree of care when pursuing a criminal than an ordinary citizen does. A doctor has a greater degree of care when performing first aid on a street than an average citizen.

But I think it's still a pretty key distinction if Zimmerman was acting as a vigilante vs. acting as if he was performing his duties as a self-appointed Neighborhood Watch captain. If he was blatantly violating his training, it's fair to question if he was acting irrationally in the heat of trying to track down Martin. If he was acting irrationally, it's fair to ask if he did something stupid to provoke an innocent man. Like I said, I don't think the prosecution will be able to prove this. But just because he's found innocent in the court of law, doesn't mean he was actually innocent. It could just mean they couldn't prove it.

The key question for me continues to be, what led Trayvon Martin to assault Zimmerman and was he significantly provoked? And I think what Florida has to figure out real damn fast is if this self defense law is giving provokers license to start shit and then defend themselves if things don't go as planned.

Again, there was a reason or reasons he wasn't arrested for 40 plus days and when he was IMHO it was a political arrest to calm down "the hood" because they were going to riot soon and still may do so if GZ ain't strung up.

IMHO GZ walks and only gets probation.

no, not true. you can fire on a person for verbally threatening your life, but you must prove your concern. you must prove the person was in position to take your life.

case in point, few weeks ago an OK woman shot a man entering her room after consulting 911.
